§ 38a AufenthG: Residence Permit for Persons with Long-Term Residence in Other Member States of the European Union
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This rule applies to you if you have the legal status of a long-term resident in another Member State of the European Union.
Your legal entitlement to a residence permit
Do you want to stay in Germany for longer than 90 days? Then the authority must grant you a residence permit. This is a legal entitlement — it is not at the authority's discretion.
Note: Section 8 paragraph 2 of the Residence Act (Aufenthaltsgesetz) does not apply to you.
When this entitlement does not apply
For some people, this legal entitlement to a residence permit does not apply. This affects:
- People whom a service provider posts to Germany as part of a cross-border service.
- People who want to provide cross-border services themselves.
- People who want to work in Germany as seasonal workers.
- People who want to take up work in Germany as cross-border commuters.
Other rules apply to these people.
Working with this residence permit
Do you want to work as an employee? Then you may only do so if the Federal Employment Agency (Bundesagentur für Arbeit) has approved this employment under section 39 paragraph 3 of the Residence Act.
Do you want to be self-employed? Then you may only do so if you meet the requirements under section 21 of the Residence Act.
Do you receive your residence permit for studies or for another training purpose? Then sections 16a and 16b of the Residence Act additionally apply to you.
Note: If your case falls under section 16a of the Residence Act, the authority must grant you the residence permit. The Federal Employment Agency does not need to approve this.
Time limit on the work permit
Do you receive your residence permit with a subsidiary provision under section 34 of the Employment Ordinance (Beschäftigungsverordnung)? Then this subsidiary provision may apply for a maximum of twelve months.
These twelve months begin at the point in time when you are permitted to take up employment for the first time. This happens when your residence permit under paragraph 1 is granted.
After these twelve months have passed, you may pursue any gainful employment with your residence permit.
