Self-employment: The most important points on Section 21 Residence Act
This section regulates the residence permit for a self-employed activity. A self-employed activity means: you work for yourself, not as an employee. In most cases, the authority itself decides whether you get the residence permit. This is called discretion.
Basic rule: Self-employed activity under paragraph 1
You can get a residence permit for a self-employed activity. The authority decides on this. It is not a guarantee.
For this, all three conditions must be met: First: There is an economic interest or a regional need for your activity. Second: Your activity is expected to have positive effects on the economy. Third: The financing of your project is secured. This can be through your own capital or through a loan commitment.
The authority checks these conditions especially based on the following points: How viable is your business idea? What entrepreneurial experience do you have? How much capital are you investing? What effects does your project have on employment and training? What contribution does your project make to innovation and research?
When checking, the authority involves other bodies. These are: expert bodies in the place of your planned activity, the responsible trade authorities, the public-law professional associations, and the authorities responsible for professional admission.
Special case: Benefits under international law (paragraph 2)
A residence permit for a self-employed activity can also be granted for another reason. This applies if there are benefits under international law based on reciprocity. Here too, the authority decides.
Special case: Graduates and researchers (paragraph 2a)
This rule applies to two groups of people. Group one: You have successfully completed your studies at a state or state-recognized institution of higher education or a comparable educational institution within Germany. Group two: You work as a researcher or scientist and hold a residence permit under Section 18b, Section 18d, or Section 19c paragraph 1, or you hold an EU Blue Card.
Paragraph 1 does not apply to you. Instead, this rule applies. Normally, you shall generally be granted a residence permit for a self-employed activity. In exceptional cases, it can be different.
There is one condition for this: Your planned self-employed activity must show a connection. The connection must be either to the knowledge from your higher education, or to your activity as a researcher or scientist.
Special case: Starting a business with a scholarship (paragraph 2b)
You can get a residence permit for a stay to start a business. The authority decides on this.
For this, both conditions must be met: First: You are a skilled worker. Second: You receive a scholarship to prepare for starting your business. This scholarship must secure your living costs. It must come from a German business organization or a German public body, from public funds.
The residence permit is valid for the duration of your scholarship. It is valid for a maximum of 18 months.
Special rule for people over 45 years old (paragraph 3)
Are you older than 45 years? Then you shall generally only get the residence permit if you have adequate provision for old age. This normally applies. In exceptional cases, it can be different.
Duration of the residence permit and path to the settlement permit (paragraph 4)
The residence permit for a self-employed activity is valid for a maximum of three years.
After three years, you can get a settlement permit. A settlement permit is an unlimited residence title. A rule that differs from Section 9 paragraph 2 applies here. The authority decides on this.
For this, all of the following conditions must be met: You have been self-employed for three years. Because of its success and duration, your current activity is expected to allow a further sustainable development of your business. Your living costs are secured through sufficient income. This also applies to the family members who live with you in a family unit and to whom you must provide maintenance. The requirement under Section 9 paragraph 2 sentence 1 number 4 is met.
Special case: Freelance activity (paragraph 5)
Do you carry out a liberal profession (freiberufliche Tätigkeit)? Then a special rule applies to you, differing from paragraph 1. You can get a residence permit for your freelance activity. The authority decides on this.
For this, one condition is necessary: Does your liberal profession require a permit? Then this permit must already have been granted, or its granting must already have been promised to you.
When checking, the same rule applies as in paragraph 1 sentence 3: The authority involves the expert bodies, the responsible trade authorities, the public-law professional associations, and the authorities responsible for professional admission.
Important: The rule from paragraph 4 does not apply here. This means: The three-year time limit and the described path to the settlement permit do not apply to the freelance activity.
Special case: Self-employed activity in addition to another purpose of stay (paragraph 6)
Do you already have a residence permit for another purpose? Or are you currently getting a residence permit for another purpose? Then you may additionally be allowed to carry out a self-employed activity. Your original purpose of stay remains in place. The authority decides on this.
One condition applies for this: Other regulations may require separate permits for your self-employed activity. These permits must already have been granted, or their granting must already have been promised to you.
