§ 8 AufenthG: Extension of the Residence Permit

Extension of the residence permit
This rule explains how your residence permit is extended.
The same rules as for the first grant For the extension of your residence permit, the same rules apply as for the first grant.
When the authority cannot extend it Sometimes your residence permit is meant for a temporary purpose from the very beginning. The authority can already exclude an extension when it first grants the permit or at the last extension. If the authority has excluded an extension in this way, it generally cannot extend your residence permit.
Checking the integration course Before the authority extends your residence permit, it must determine whether you had a duty to properly take part in an integration course and whether you fulfilled that duty.
If you violated your duty under Section 44a Paragraph 1 Sentence 1 to properly take part in the integration course, the authority must take this into account when it decides on the extension. This is a duty — it must do so.
If you have no legal entitlement to the residence permit and you have repeatedly and seriously violated your duty to take part in the integration course, the authority shall generally refuse the extension. This means: as a rule, the authority then refuses. Only in special exceptional cases does it not do so.
If you have a claim to an extension only under this law, the Residence Act, the authority can still refuse the extension. The authority decides this on a case-by-case basis. There is one exception: if you prove that you are integrated into social and community life in another way, the authority cannot refuse the extension for that reason.
When deciding, the authority must also take into account:
- how long you have already been living lawfully in Germany,
- whether you have a bond with Germany worthy of protection,
- what consequences the end of your stay would have for your family members who are living lawfully in Germany.
If you were obliged to take part in an integration course under Section 44a Paragraph 1 Sentence 1, or still are, the authority shall generally extend your residence permit for no more than one year at a time. This applies as long as you have not yet successfully completed the integration course or have not yet proven that you are integrated into social and community life in another way. This means: as a rule, you then only get an extension of at most one year. Only in special exceptional cases is it different.
Exception for certain residence permits The check of the integration course does not apply if your residence permit is extended under Section 25 Paragraph 1, Paragraph 2, or Paragraph 3.
(1) Auf die Verlängerung der Aufenthaltserlaubnis finden dieselben Vorschriften Anwendung wie auf die Erteilung.
(2) Die Aufenthaltserlaubnis kann in der Regel nicht verlängert werden, wenn die zuständige Behörde dies bei einem seiner Zweckbestimmung nach nur vorübergehenden Aufenthalt bei der Erteilung oder der zuletzt erfolgten Verlängerung der Aufenthaltserlaubnis ausgeschlossen hat.
(3) Vor der Verlängerung der Aufenthaltserlaubnis ist festzustellen, ob der Ausländer einer etwaigen Pflicht zur ordnungsgemäßen Teilnahme am Integrationskurs nachgekommen ist. Verletzt ein Ausländer seine Verpflichtung nach § 44a Abs. 1 Satz 1 zur ordnungsgemäßen Teilnahme an einem Integrationskurs, ist dies bei der Entscheidung über die Verlängerung der Aufenthaltserlaubnis zu berücksichtigen. Besteht kein Anspruch auf Erteilung der Aufenthaltserlaubnis, soll bei wiederholter und gröblicher Verletzung der Pflichten nach Satz 1 die Verlängerung der Aufenthaltserlaubnis abgelehnt werden. Besteht ein Anspruch auf Verlängerung der Aufenthaltserlaubnis nur nach diesem Gesetz, kann die Verlängerung abgelehnt werden, es sei denn, der Ausländer erbringt den Nachweis, dass seine Integration in das gesellschaftliche und soziale Leben anderweitig erfolgt ist. Bei der Entscheidung sind die Dauer des rechtmäßigen Aufenthalts, schutzwürdige Bindung des Ausländers an das Bundesgebiet und die Folgen einer Aufenthaltsbeendigung für seine rechtmäßig im Bundesgebiet lebenden Familienangehörigen zu berücksichtigen. War oder ist ein Ausländer zur Teilnahme an einem Integrationskurs nach § 44a Absatz 1 Satz 1 verpflichtet, soll die Verlängerung der Aufenthaltserlaubnis jeweils auf höchstens ein Jahr befristet werden, solange er den Integrationskurs noch nicht erfolgreich abgeschlossen oder noch nicht den Nachweis erbracht hat, dass seine Integration in das gesellschaftliche und soziale Leben anderweitig erfolgt ist.
(4) Absatz 3 ist nicht anzuwenden auf die Verlängerung einer nach § 25 Absatz 1, 2 oder Absatz 3 erteilten Aufenthaltserlaubnis.
