§ 60c AufenthG: Training Toleration (Duldung)

Section 60c AufenthG – Ausbildungsduldung (Toleration Status for Vocational Training)
This section tells you when you get a toleration status (Duldung) for vocational training. This toleration status is called the Ausbildungsduldung. It is a special form of toleration status (Duldung) under Section 60a paragraph 2 sentence 3.
When must the authority give you the Ausbildungsduldung?
The authority must give you the Ausbildungsduldung if one of these situations applies to you.
Situation 1: You are an asylum seeker. Then one of two options applies: a) You have started a qualified vocational training. The training occupation must be recognized by the state or regulated in a comparable way. b) You have started an assistant or helper training. This occupation must also be recognized by the state or regulated in a comparable way. This training must be able to lead into a qualified vocational training in a shortage occupation. A shortage occupation is an occupation for which the Bundesagentur für Arbeit (Federal Employment Agency) has identified a shortage. For this follow-on training, you must already have been promised a training place. After the rejection of your asylum application, you want to continue this vocational training.
Situation 2: You already hold a toleration status (Duldung) under Section 60a. And you start a vocational training as described in Situation 1.
Exception: In cases of obvious abuse, the authority may refuse the Ausbildungsduldung. This is a discretionary decision. The authority then decides on a case-by-case basis.
If you receive the Ausbildungsduldung under Situation 1 or Situation 2, the authority must also give you a Beschäftigungserlaubnis (work permit). This is the permission to work during the training.
When do you not get the Ausbildungsduldung?
The authority must not give you the Ausbildungsduldung if one of these reasons applies.
Reason 1: There is a ground for exclusion under Section 60a paragraph 6.
Reason 2: This reason only applies if you apply for the Ausbildungsduldung under Situation 2. At the time of your application, you have not yet held a toleration status (Duldung) for three months.
Reason 3: Your identity has not been clarified. Different deadlines apply for clarifying your identity. Which deadline applies to you depends on when you entered Germany. a) If you entered by 31 December 2016, your identity must be clarified by the time you apply for the Ausbildungsduldung. b) If you entered on or after 1 January 2017 and before 1 January 2020, your identity must be clarified by the time you apply, but no later than 30 June 2020. c) If you entered after 31 December 2019, your identity must be clarified within the first six months after entry. Exception: The deadline is still considered met if two conditions are fulfilled together. Condition 1: Within the deadline, you took all necessary steps that could reasonably be expected of you to clarify your identity. Condition 2: Your identity can only be clarified after the deadline, through no fault of your own. Only if both conditions apply together is the deadline still considered met.
Reason 4: There is a ground for exclusion under Section 19d paragraph 1 number 6 or 7. Or: There is an Ausweisungsverfügung (expulsion order) against you, or a deportation order under Section 58a.
Reason 5: This reason only applies if you apply for the Ausbildungsduldung under Situation 2. At the time of your application, concrete measures to end your stay are imminent. These measures must have a sufficient factual and time-related connection to the ending of your stay. This is the case if: a) a medical examination of your fitness to travel has been arranged, b) you have applied for state-funded voluntary departure, c) the booking of transport for your deportation has been initiated, d) comparably concrete preparations for your deportation have been initiated. Exception: It is clear from the outset that these measures will not succeed, e) a procedure to determine the responsible member state has been initiated. This procedure follows free legal information under Article 38 paragraph 1 of Regulation (EU) 2024/1351.
When can you submit the application, and how long does the toleration status (Duldung) apply?
You can submit the application at the earliest seven months before the start of the vocational training.
If you apply for the Ausbildungsduldung under Situation 2, it is granted at the earliest six months before the start of the training.
The authority must give you the Ausbildungsduldung if, at the time of application, at least one of these conditions is met:
- The entry of your training contract in the register of vocational training relationships has already been applied for, or has already been made, with the responsible body.
- If such an entry is not required: Your training contract with an educational institution has been concluded. Or a state or state-recognized educational institution has approved the training contract.
The Ausbildungsduldung applies for the duration set out in your training contract.
When does the Ausbildungsduldung end automatically?
The Ausbildungsduldung expires if one of these situations occurs:
- A ground for exclusion under Reason 4 (see above) occurs.
- The training is ended early or discontinued.
What must the educational institution do when the training ends?
If the training is ended early or discontinued, the educational institution must notify the responsible Ausländerbehörde (foreigners authority) without delay. Normally, this must happen within two weeks. The notification must be made in writing or electronically. The notification must state: the facts being reported, the date on which they occurred, as well as your first name, your last name, and your nationality.
What happens if your training ends early?
If your training relationship is ended early or discontinued, the authority must give you a one-time toleration status (Duldung) for six months. During this time, you can look for a new training place for a vocational training under the situations named above.
If you have successfully completed your vocational training, but are not then kept on by your training company afterwards: The authority must extend your toleration status (Duldung) by six months. During this time, you can look for employment that matches the professional qualification you have gained.
Important: The toleration status (Duldung) given to you to search for a new training place must not be extended again for this purpose.
Exception for clarifying your identity
The authority can still give you the Ausbildungsduldung, even if the deadline for clarifying your identity from Reason 3 (see above) was not met. Requirement for this: You took all necessary steps that could reasonably be expected of you to clarify your identity. This is a discretionary decision by the authority. The authority decides on a case-by-case basis.
Other
Section 60a otherwise remains unchanged and valid.
(1) Eine Duldung im Sinne von § 60a Absatz 2 Satz 3 ist zu erteilen, wenn der Ausländer in Deutschland
- 1.als Asylbewerber eine
- a)qualifizierte Berufsausbildung in einem staatlich anerkannten oder vergleichbar geregelten Ausbildungsberuf aufgenommen hat oder
- b)Assistenz- oder Helferausbildung in einem staatlich anerkannten oder vergleichbar geregelten Ausbildungsberuf aufgenommen hat, an die eine qualifizierte Berufsausbildung in einem staatlich anerkannten oder vergleichbar geregelten Ausbildungsberuf, für den die Bundesagentur für Arbeit einen Engpass festgestellt hat, anschlussfähig ist und dazu eine Ausbildungsplatzzusage vorliegt, und nach Ablehnung des Asylantrags diese Berufsausbildung fortsetzen möchte oder
- 2.im Besitz einer Duldung nach § 60a ist und eine in Nummer 1 genannte Berufsausbildung aufnimmt. In Fällen offensichtlichen Missbrauchs kann die Ausbildungsduldung versagt werden. Im Fall des Satzes 1 ist die Beschäftigungserlaubnis zu erteilen.
(2) Die Ausbildungsduldung wird nicht erteilt, wenn
- 1.ein Ausschlussgrund nach § 60a Absatz 6 vorliegt,
- 2.im Fall von Absatz 1 Satz 1 Nummer 2 der Ausländer bei Antragstellung noch nicht drei Monate im Besitz einer Duldung ist,
- 3.die Identität nicht geklärt ist
- a)bei Einreise in das Bundesgebiet bis zum 31. Dezember 2016 bis zur Beantragung der Ausbildungsduldung, oder
- b)bei Einreise in das Bundesgebiet ab dem 1. Januar 2017 und vor dem 1. Januar 2020 bis zur Beantragung der Ausbildungsduldung, spätestens jedoch bis zum 30. Juni 2020 oder
- c)bei Einreise in das Bundesgebiet nach dem 31. Dezember 2019 innerhalb der ersten sechs Monate nach der Einreise; die Frist gilt als gewahrt, wenn der Ausländer innerhalb der in den Buchstaben a bis c genannten Frist alle erforderlichen und ihm zumutbaren Maßnahmen für die Identitätsklärung ergriffen hat und die Identität erst nach dieser Frist geklärt werden kann, ohne dass der Ausländer dies zu vertreten hat,
- 4.ein Ausschlussgrund nach § 19d Absatz 1 Nummer 6 oder 7 vorliegt oder gegen den Ausländer eine Ausweisungsverfügung oder eine Abschiebungsanordnung nach § 58a besteht, oder
- 5.im Fall von Absatz 1 Satz 1 Nummer 2 zum Zeitpunkt der Antragstellung konkrete Maßnahmen zur Aufenthaltsbeendigung, die in einem hinreichenden sachlichen und zeitlichen Zusammenhang zur Aufenthaltsbeendigung stehen, bevorstehen; diese konkreten Maßnahmen zur Aufenthaltsbeendigung stehen bevor, wenn
- a)eine ärztliche Untersuchung zur Feststellung der Reisefähigkeit veranlasst wurde,
- b)der Ausländer einen Antrag zur Förderung mit staatlichen Mitteln einer freiwilligen Ausreise gestellt hat,
- c)die Buchung von Transportmitteln für die Abschiebung eingeleitet wurde,
- d)vergleichbar konkrete Vorbereitungsmaßnahmen zur Abschiebung des Ausländers eingeleitet wurden, es sei denn, es ist von vornherein absehbar, dass diese nicht zum Erfolg führen, oder
- e)ein Verfahren zur Bestimmung des zuständigen Mitgliedstaates gemäß einer unentgeltlichen Rechtsauskunft gemäß Artikel 38 Absatz 1 der Verordnung (EU) 2024/1351 eingeleitet wurde.
(3) Der Antrag auf Erteilung der Ausbildungsduldung kann frühestens sieben Monate vor Beginn der Berufsausbildung gestellt werden. Die Ausbildungsduldung nach Absatz 1 Satz 1 Nummer 2 wird frühestens sechs Monate vor Beginn der Berufsausbildung erteilt. Sie wird erteilt, wenn zum Zeitpunkt der Antragstellung auf Erteilung der Ausbildungsduldung die Eintragung des Ausbildungsvertrages in das Verzeichnis der Berufsausbildungsverhältnisse bei der zuständigen Stelle bereits beantragt wurde oder die Eintragung erfolgt ist oder, soweit eine solche Eintragung nicht erforderlich ist, der Ausbildungsvertrag mit einer Bildungseinrichtung geschlossen wurde oder die Zustimmung einer staatlichen oder staatlich anerkannten Bildungseinrichtung zu dem Ausbildungsvertrag vorliegt. Die Ausbildungsduldung wird für die im Ausbildungsvertrag bestimmte Dauer der Berufsausbildung erteilt.
(4) Die Ausbildungsduldung erlischt, wenn ein Ausschlussgrund nach Absatz 2 Nummer 4 eintritt oder die Ausbildung vorzeitig beendet oder abgebrochen wird.
(5) Wird die Ausbildung vorzeitig beendet oder abgebrochen, ist die Bildungseinrichtung verpflichtet, dies unverzüglich, in der Regel innerhalb von zwei Wochen, der zuständigen Ausländerbehörde schriftlich oder elektronisch mitzuteilen. In der Mitteilung sind neben den mitzuteilenden Tatsachen und dem Zeitpunkt ihres Eintritts die Namen, Vornamen und die Staatsangehörigkeit des Ausländers anzugeben.
(6) Wird das Ausbildungsverhältnis vorzeitig beendet oder abgebrochen, wird dem Ausländer einmalig eine Duldung für sechs Monate zum Zweck der Suche nach einem weiteren Ausbildungsplatz zur Aufnahme einer Berufsausbildung nach Absatz 1 erteilt. Die Duldung wird für sechs Monate zum Zweck der Suche nach einer der erworbenen beruflichen Qualifikation entsprechenden Beschäftigung verlängert, wenn nach erfolgreichem Abschluss der Berufsausbildung, für die die Duldung erteilt wurde, eine Weiterbeschäftigung im Ausbildungsbetrieb nicht erfolgt; die zur Arbeitsplatzsuche erteilte Duldung darf für diesen Zweck nicht verlängert werden.
(7) Eine Duldung nach Absatz 1 Satz 1 kann unbeachtlich des Absatzes 2 Nummer 3 erteilt werden, wenn der Ausländer die erforderlichen und ihm zumutbaren Maßnahmen für die Identitätsklärung ergriffen hat.
(8) § 60a bleibt im Übrigen unberührt.
