Return Transport Obligation of Transport Companies (§ 64 AufenthG)
Transport companies (for example airlines) must bring foreigners back under certain conditions.
When must the company bring you back?
If you are turned back at the border, the company must take you out of the country without delay. This applies to the company that carried you to the border.
How long does this obligation last?
The obligation lasts for 3 years. It covers foreigners who were carried to Germany without the required passport, passport substitute or residence permit and who were not turned back on entry. The reason is that they invoked:
- political persecution,
- persecution within the meaning of Article 10 of Regulation (EU) 2024/1347,
- the risk of serious harm within the meaning of Article 15 of Regulation (EU) 2024/1347, or
- the circumstances under § 60 para. 2, 3, 5 or 7.
The obligation expires once you receive a residence permit under the Residence Act.
Where will you be taken?
The border authorities can require the company to take you:
- to the country that issued your travel document,
- to the country from which you were carried, or
- to another country in which your entry is guaranteed.
