What is this section about?
For the permanent EU residence permit you need a certain period of residence in Germany. This required period is set out in Section 9a paragraph 2 sentence 1 number 1 of the Residence Act.
This section tells you: which other periods does the authority add to this required period? And which periods interrupt the required period?
These periods are added (paragraph 1)
The following periods are counted towards the required period.
1. Periods abroad with a residence title
You had a residence title and were abroad. Two cases are possible:
- You were abroad because of a work posting. This period counts if it did not last longer than six months. Has the immigration authority set a longer period under Section 51 paragraph 1 number 7? Then this longer period counts instead.
- Or: the period abroad did not last longer than six months at a stretch. And in total, within the required period under Section 9a paragraph 2 sentence 1 number 1, it did not last more than ten months.
2. An earlier period of residence in Germany
You were already in Germany before – with a residence permit, a settlement permit, or a permanent EU residence permit. This earlier period counts, up to a maximum of four years, if all of the following points apply:
- When you left Germany, you had a settlement permit or a permanent EU residence permit.
- This permit has lapsed. And only for one of these two reasons: you stayed outside the member states of the European Union. Or you obtained the legal status of a long-term resident in another EU member state.
3. Periods with freedom-of-movement entitlement
Were you entitled to freedom of movement (for example as an EU citizen)? These periods count.
4. Studies or vocational training in Germany
Did you have a lawful residence in Germany for the purpose of studies or vocational training? This period counts at half its value.
5. Time as a beneficiary of international protection
Did you apply for international protection and later receive a residence title because of it? Then the period between the day of your application and the day this residence title was granted counts.
These periods do not count
- Periods of a stay under Section 9a paragraph 3 number 5.
- Periods during which you also met the requirements of Section 9a paragraph 3 number 3 at the same time.
When does a stay abroad interrupt the required period?
- Did your residence title not lapse because of the stay abroad? Then this stay abroad does not interrupt your required period. But note: this period abroad still does not count towards the total length of the required period.
- In all other cases, leaving Germany interrupts the required period.
- Special case for beneficiaries of protection: Were you granted international protection in Germany, and do you then encounter the authorities in another EU member state – and do you have no right of residence there, whether under that state's national law, under Union law, or under international law? Then this also interrupts your required period. This period, too, does not count towards the total length.
Periods with a title from another EU member state (paragraph 2)
These periods are also counted towards the required period under Section 9a paragraph 2 sentence 1 number 1:
- Period with an EU Blue Card issued by another member state of the European Union.
- Period with a residence title issued by another member state of the European Union, specifically for:
- employment that requires a university degree – or an equivalent qualification from a course of study of at least three years at level 6 of the International Standard Classification of Education (ISCED 2011) or level 6 of the European Qualifications Framework,
- research,
- studies, or
- your legal status as a beneficiary of international protection.
This counting only applies if both of the following points apply:
- At the time you submit your application, you have already been living in Germany with an EU Blue Card for at least two years.
- Immediately before that, you had an EU Blue Card issued by another EU member state.
Periods of study in another member state: Did you have a residence title there for the purpose of studies? Then the same rule as under number 4 above applies: this period counts at half its value.
Periods outside the European Union do not count. But: these periods still do not interrupt your required period if they do not exceed twelve consecutive months and, in total, within the required period, do not amount to more than 18 months.
Family members: All rules in this paragraph 2 apply correspondingly to your family members too. Requirement: they have received a residence permit under Section 30 or Section 32 of the Residence Act.
