§ 32 AufenthG: Reunification of Children

This rule is called "Kindernachzug" (child family reunification). It applies if you are the minor, unmarried child of a foreign national and want to move to Germany to join them.
Legal entitlement to a residence permit
You have a legal entitlement to a residence permit if you are the minor, unmarried child of a foreign national. The authority must then grant you a residence permit. This is mandatory — it is not at the authority's discretion.
For this, both parents must hold one of these residence titles. Or it is enough if the parent who has sole custody holds one — this is the parent who alone has custody of you.
These residence titles count:
- A residence permit under Section 7(1) sentence 3, or under Section 3 or 4.
- A residence permit under Section 25(1) or Section 25(2) sentence 1.
- A residence permit under Section 28, Section 30, Section 31, Section 36 or Section 36a.
- A residence permit under any other provisions. Exception: A residence permit under Section 25(2) sentence 2 does not count here.
- An EU Blue Card, an ICT Card or a Mobile ICT Card.
- A settlement permit.
- A permit for permanent residence – EU.
Additional condition from age 16
Are you already 16 years old? And are you NOT moving the centre of your life to Germany together with your parents or with the parent who has sole custody? Then the entitlement above applies only under an additional condition.
The condition: You have a good command of the German language. Or: Based on your previous education and living circumstances, it appears assured that you can adapt to living conditions in Germany.
This additional condition does NOT apply if one of the following three cases applies:
Case 1: The foreign national holds a residence permit under Section 23(4) or under Section 25(1) or (2). Or they hold a settlement permit under Section 26(3). Or — following prior grant of a residence permit under Section 25(2) sentence 2 — they hold a settlement permit under Section 26(4).
Case 2: The foreign national holds one of the following permits. Or their spouse holds it, if they live with them in a family unit. These permits count: a settlement permit under Section 18c(3); an EU Blue Card; an ICT Card; a Mobile ICT Card; a residence permit under Section 18a, Section 18b, Section 18d or Section 18f; a residence permit under Section 19c(1) for employment as a senior employee, as a manager, as a company specialist, as a scientist, as a guest scientist, as an engineer or technician in a guest scientist's research team, or as a teacher; a residence permit under Section 19c(2) or Section 19c(4) sentence 1; or a residence permit under Section 21.
Case 3: Immediately before the grant of a settlement permit or a permit for permanent residence – EU, the foreign national held one of the following titles. Or their spouse held it, if they live with them in a family unit. These titles count: an EU Blue Card; a residence permit under Section 18a, Section 18b or Section 18d; a residence permit under Section 19c(1) for the same types of employment as in Case 2; a residence permit under Section 19c(2) or Section 19c(4) sentence 1; or a residence permit under Section 21.
Joining only one parent when custody is shared
Do both parents share custody of you? Then the authority shall generally also grant you a residence permit if you move to join only one parent who has custody. In exceptional cases, the authority may decide differently.
For this, one of these two conditions must be met:
- The other parent has given their consent to your stay in Germany. Or:
- There is a corresponding legally binding decision from a competent authority.
Residence permit in special cases of hardship
Do you not meet the conditions above? Then you can still receive a residence permit. The authority decides this on a case-by-case basis.
Condition for this: it is necessary, due to the circumstances of your individual case, in order to avoid a special hardship.
The authority must take your best interests as a child and your family situation into account when deciding.
Special rule: If your parents hold a residence permit under Section 25(2) sentence 2, then Section 36a applies to you instead.
No separate residence title when moving from another EU country
Is the foreign national lawfully staying in Germany under Section 18e? Then you, as their minor, unmarried child, do not need a separate residence title. One condition applies for this.
The condition: You must prove that you lawfully resided in the other European Union member state as a family member of the foreign national.
In addition, the following apply to you accordingly: the conditions under Section 18e(1) sentence 1 numbers 1, 3 and 4, as well as under Section 18e(6) sentence 1. The grounds for refusal under Section 19f also apply to you accordingly.
(1) Dem minderjährigen ledigen Kind eines Ausländers ist eine Aufenthaltserlaubnis zu erteilen, wenn beide Eltern oder der allein personensorgeberechtigte Elternteil einen der folgenden Aufenthaltstitel besitzt:
- 1.Aufenthaltserlaubnis nach § 7 Absatz 1 Satz 3 oder nach Abschnitt 3 oder 4,
- 2.Aufenthaltserlaubnis nach § 25 Absatz 1 oder Absatz 2 Satz 1,
- 4.Aufenthaltserlaubnis nach den übrigen Vorschriften mit Ausnahme einer Aufenthaltserlaubnis nach § 25 Absatz 2 Satz 2,
- 5.Blaue Karte EU, ICT-Karte, Mobiler-ICT-Karte,
- 6.Niederlassungserlaubnis oder
- 7.Erlaubnis zum Daueraufenthalt – EU.
(2) Hat das minderjährige ledige Kind bereits das 16. Lebensjahr vollendet und verlegt es seinen Lebensmittelpunkt nicht zusammen mit seinen Eltern oder dem allein personensorgeberechtigten Elternteil in das Bundesgebiet, gilt Absatz 1 nur, wenn es die deutsche Sprache beherrscht oder gewährleistet erscheint, dass es sich auf Grund seiner bisherigen Ausbildung und Lebensverhältnisse in die Lebensverhältnisse in der Bundesrepublik Deutschland einfügen kann. Satz 1 gilt nicht, wenn
- 1.der Ausländer eine Aufenthaltserlaubnis nach § 23 Absatz 4, § 25 Absatz 1 oder 2, eine Niederlassungserlaubnis nach § 26 Absatz 3 oder nach Erteilung einer Aufenthaltserlaubnis nach § 25 Absatz 2 Satz 2 eine Niederlassungserlaubnis nach § 26 Absatz 4 besitzt,
- 2.der Ausländer oder sein mit ihm in familiärer Lebensgemeinschaft lebender Ehegatte eine Niederlassungserlaubnis nach § 18c Absatz 3, eine Blaue Karte EU, eine ICT-Karte oder eine Mobiler-ICT-Karte oder eine Aufenthaltserlaubnis nach den §§ 18a, 18b, 18d, 18f, § 19c Absatz 1 für eine Beschäftigung als leitender Angestellter, als Führungskraft, als Unternehmensspezialist, als Wissenschaftler, als Gastwissenschaftler, als Ingenieur oder Techniker im Forschungsteam eines Gastwissenschaftlers oder als Lehrkraft, § 19c Absatz 2 oder 4 Satz 1 oder § 21 besitzt, oder
- 3.der Ausländer oder sein mit ihm in familiärer Lebensgemeinschaft lebender Ehegatte unmittelbar vor der Erteilung einer Niederlassungserlaubnis oder einer Erlaubnis zum Daueraufenthalt – EU Inhaber einer Blauen Karte EU oder einer Aufenthaltserlaubnis nach den §§ 18a, 18b, 18d, 19c Absatz 1 für eine Beschäftigung als leitender Angestellter, als Führungskraft, als Unternehmensspezialist, als Wissenschaftler, als Gastwissenschaftler, als Ingenieur oder Techniker im Forschungsteam eines Gastwissenschaftlers oder als Lehrkraft, § 19c Absatz 2 oder 4 Satz 1 oder § 21 war.
(3) Bei gemeinsamem Sorgerecht soll eine Aufenthaltserlaubnis nach den Absätzen 1 und 2 auch zum Nachzug zu nur einem sorgeberechtigten Elternteil erteilt werden, wenn der andere Elternteil sein Einverständnis mit dem Aufenthalt des Kindes im Bundesgebiet erklärt hat oder eine entsprechende rechtsverbindliche Entscheidung einer zuständigen Stelle vorliegt.
(4) Im Übrigen kann dem minderjährigen ledigen Kind eines Ausländers eine Aufenthaltserlaubnis erteilt werden, wenn es auf Grund der Umstände des Einzelfalls zur Vermeidung einer besonderen Härte erforderlich ist. Hierbei sind das Kindeswohl und die familiäre Situation zu berücksichtigen. Für minderjährige ledige Kinder von Ausländern, die eine Aufenthaltserlaubnis nach § 25 Absatz 2 Satz 2 besitzen, gilt § 36a.
(5) Hält sich der Ausländer gemäß § 18e berechtigt im Bundesgebiet auf, so bedarf das minderjährige ledige Kind keines Aufenthaltstitels, wenn nachgewiesen wird, dass sich das Kind in dem anderen Mitgliedstaat der Europäischen Union rechtmäßig als Angehöriger des Ausländers aufgehalten hat. Die Voraussetzungen nach § 18e Absatz 1 Satz 1 Nummer 1, 3 und 4 und Absatz 6 Satz 1 und die Ablehnungsgründe nach § 19f gelten für das minderjährige Kind entsprechend.
