This rule explains: When do you have stable and regular income?
The legal term "stable and regular income" comes from § 9a paragraph 2 sentence 1 number 2. This rule tells you when this income normally exists. In exceptional cases, it can be different.
Normally, you have stable and regular income if all of the following four conditions are met.
You have fulfilled your tax obligations. You have complied with your tax obligations.
You or your spouse have made provisions for old age. You yourself, or your spouse with whom you live in a family unit, have made contributions or expenditures for adequate old-age provision. This can have happened in Germany or abroad. Exception: This condition does not apply if a physical, mental, or psychological illness or a disability has prevented you from doing so.
You and your family members are covered against illness and the need for long-term care. You and your family members who live with you in a family unit must be covered against the risks of illness and the need for long-term care. This works in two ways: through statutory health insurance or through insurance cover that is essentially equivalent. This other insurance cover must be unlimited in time or renew automatically.
If your income comes from employment: You must be allowed to carry out this employment. This condition only applies if your regular income comes from employment. You must be entitled to carry out this employment. You must also have all other permits necessary for it.
Exception for married couples Do you live together as a married couple in a marital union? Then it is enough if only one of you meets condition number 4.
Limit on old-age provision contributions A limit applies to condition number 2. You cannot be required to make higher contributions or expenditures than provided for in § 9 paragraph 2 sentence 1 number 3.
