§ 30 AufenthG: Spousal Reunification

What is this section about?
This section regulates spousal reunification (Ehegattennachzug). This means: Your spouse already lives in Germany. You want to move to Germany to join him or her.
When do you have a legal entitlement to a residence permit?
The authority must grant you a residence permit if you meet all of the following three requirements. This is not a discretionary decision — it is an obligation of the authority.
Requirement 1: Age
You and your spouse must both be at least 18 years old.
Requirement 2: Language skills
You must be able to communicate in German, at least in a simple way.
Requirement 3: Your spouse's residence title
Your spouse — the person you want to move to — must hold one of the following titles:
- a settlement permit, or
- a permit for permanent residence – EU, or
- a residence permit under Section 18d, Section 18f or Section 25 (1) or (2) sentence 1, or
- a residence permit held for two years. This must not carry a specific restriction under Section 8 (2). In addition, a later settlement permit must not be excluded by law. Exception: This does not apply if your spouse holds a residence permit under Section 25 (2) sentence 2, or
- a residence permit under Section 7 (1) sentence 3 or under Chapters 3, 4, 5 or 6, or under Section 37 or Section 38. For this, the marriage must already have existed when this residence permit was granted. And the stay in Germany must be expected to last more than one year. Exception: This does not apply if your spouse holds a residence permit under Section 25 (2) sentence 2, or
- a residence permit under Section 38a. For this, the marital union must already have existed in the other EU member state where your spouse is recognized as a long-term resident, or
- an EU Blue Card, an ICT Card or a Mobile ICT Card.
Exception: If your spouse is moving from another EU country
If the last point above applies — a residence permit under Section 38a with the marriage existing in the other EU member state — then you do not have to meet Requirement 1 (age) and Requirement 2 (language).
Exception: When only the language requirement does not apply
You do not have to meet Requirement 2 (language skills) if one of the following cases applies:
- Your spouse holds a residence title under Section 23 (4), Section 25 (1) or (2), Section 26 (3), or a settlement permit under Section 26 (4) (following a prior residence permit under Section 25 (2) sentence 2). In addition, the marriage must already have existed when your spouse moved the center of their life to Germany.
- You cannot prove simple German language skills because of a physical, mental or psychological illness or disability.
- You have a recognizably low need for integration. This is set out in a statutory ordinance under Section 43 (4). Or, for other reasons, you would not have a legal entitlement under Section 44 to participate in an integration course after entering the country.
- Because of their nationality, your spouse is allowed to enter Germany and stay here without a visa — even for a stay that is not a short stay.
- Your spouse holds an EU Blue Card, an ICT Card, a Mobile ICT Card, or a residence title under Section 18a, Section 18b, Section 18c (3), Section 18d, Section 18f or Section 19c (1) — for employment as a senior employee, manager, intra-corporate specialist, scientist, guest scientist, engineer or technician on a guest scientist's research team, or as a teacher. The same applies to a title under Section 19c (2) or (4) sentence 1, or under Section 21.
- Because of special circumstances in your individual case, it is not possible or not reasonable for you to make an effort to acquire simple German language skills before entering the country.
- Immediately before being granted a settlement permit or a permit for permanent residence – EU, your spouse held an EU Blue Card or a residence permit under Section 18a, Section 18b, Section 18d, Section 19c (1) — for the same types of employment as in point 5 —, or under Section 19c (2) or (4) sentence 1, or under Section 21.
Discretion: Exceptions to the rule
The authority may grant you a residence permit even if you do not meet Requirement 1 (age). This is only possible to avoid a particular hardship. The authority decides this on a case-by-case basis — you have no legal entitlement to it.
If your spouse holds a residence permit, the authority may waive the additional requirements of letter e. This means: the authority then does not need to check whether the marriage already existed when the permit was granted and whether the stay is expected to last more than one year. The same applies if your spouse holds a national visa.
Extension of the residence permit
The authority may extend your residence permit for as long as the marital union — living together as a married couple — continues to exist. This also applies if certain other requirements under Section 5 (1) no. 1 and Section 29 (1) no. 2 are not met. This, too, is a discretionary decision, not an automatic one.
If your spouse is married to several people
If your spouse is married to several spouses at the same time and lives together with one spouse in Germany, no further spouse will receive a residence permit under this rule.
Special case: If your spouse is in Germany under Section 18e
If your spouse is lawfully staying in Germany under Section 18e, you do not need your own residence title. Requirement: You must prove that you lawfully stayed in the other EU member state as a family member of your spouse.
In addition, certain requirements from Section 18e apply to you — (1) sentence 1 nos. 1, 3 and 4, as well as (6) sentence 1 — and the grounds for refusal from Section 19f apply accordingly.
