§ 10 AufenthG: Residence Title in the Case of an Asylum Application

Residence title during the asylum procedure
You have submitted an asylum application. A final decision on your application has not yet been made.
Do you have no legal entitlement to a residence title? Then during this time you can only get a residence title under two conditions. First condition: The highest state authority must agree. Second condition: Important interests of the Federal Republic of Germany must require it. The authority decides in each individual case whether to give you the residence title.
Do you have a legal entitlement that is not based on § 18a or § 18b? Then these two conditions do not apply to you.
Do you have a legal entitlement under § 18a or § 18b? Then the two conditions still apply. You may only get a residence title before the final end of your asylum procedure if the highest state authority agrees and important interests of the Federal Republic of Germany require it.
Extension of an existing residence title
Did you receive a residence title, or have it extended, by the foreigners authority after your entry? Then this residence title can continue to be extended under the rules of this law. The authority decides on this. This also applies if you have submitted an asylum application. Your asylum application does not change this.
Residence title after refusal or withdrawal of the asylum application
Was your asylum application refused unappealably? This means: The refusal is final. You can no longer do anything against it. Or have you withdrawn your asylum application? In both cases, before you leave the country, you may only get a residence title under the rules of Section 5.
There is a special prohibition for certain grounds of refusal. Is the refusal of your asylum application under § 30 of the Asylum Act based on Article 42 paragraph 1 subparagraph 1 letter c, d or f of Regulation (EU) 2024/1348? Or is it based on Article 42 paragraph 3 letter b of this Regulation? Then, before you leave the country, you may under no circumstances get a residence title. This is prohibited.
There are exceptions to both rules above. If you have a legal entitlement to a residence title, the two rules above do not apply to you. The prohibition for certain grounds of refusal also does not apply if you meet the requirements for a residence permit under § 25 paragraph 3.
There is an additional prohibition for residence titles under § 18a, § 18b or § 19c paragraph 2. If your asylum application was refused unappealably, before you leave the country you may under no circumstances get a residence title under § 18a, § 18b or § 19c paragraph 2.
If you have withdrawn your asylum application, a different rule applies for § 18a, § 18b and § 19c paragraph 2. Before you leave the country, you may only get a residence title under § 18a, § 18b or § 19c paragraph 2 if you entered Germany before 29 March 2023. The same rule applies to a residence permit under Section 6 for your spouse. The same rule also applies to a residence permit under Section 6 for your minor unmarried child. They too only get this residence permit if you entered before 29 March 2023.
(1) Einem Ausländer, der einen Asylantrag gestellt hat, kann vor dem bestandskräftigen Abschluss des Asylverfahrens ein Aufenthaltstitel außer in den Fällen eines gesetzlichen Anspruchs nur mit Zustimmung der obersten Landesbehörde und nur dann erteilt werden, wenn wichtige Interessen der Bundesrepublik Deutschland es erfordern. In den Fällen eines gesetzlichen Anspruchs nach § 18a oder § 18b darf vor dem bestandskräftigen Abschluss des Asylverfahrens ein Aufenthaltstitel nur mit Zustimmung der obersten Landesbehörde und nur dann erteilt werden, wenn wichtige Interessen der Bundesrepublik Deutschland es erfordern.
(2) Ein nach der Einreise des Ausländers von der Ausländerbehörde erteilter oder verlängerter Aufenthaltstitel kann nach den Vorschriften dieses Gesetzes ungeachtet des Umstandes verlängert werden, dass der Ausländer einen Asylantrag gestellt hat.
(3) Einem Ausländer, dessen Asylantrag unanfechtbar abgelehnt worden ist oder der seinen Asylantrag zurückgenommen hat, darf vor der Ausreise ein Aufenthaltstitel nur nach Maßgabe des Abschnitts 5 erteilt werden. Sofern sich die Ablehnung des Asylantrags nach § 30 des Asylgesetzes auf Artikel 42 Absatz 1 Unterabsatz 1 Buchstabe c, d oder f oder Absatz 3 Buchstabe b der Verordnung (EU) 2024/1348 stützt, darf vor der Ausreise kein Aufenthaltstitel erteilt werden. Die Sätze 1 und 2 finden im Falle eines Anspruchs auf Erteilung eines Aufenthaltstitels keine Anwendung; Satz 2 ist ferner nicht anzuwenden, wenn der Ausländer die Voraussetzungen für die Erteilung einer Aufenthaltserlaubnis nach § 25 Absatz 3 erfüllt. Ein Aufenthaltstitel nach § 18a, § 18b oder § 19c Absatz 2 darf einem Ausländer, dessen Asylantrag unanfechtbar abgelehnt worden ist, vor der Ausreise nicht erteilt werden. Einem Ausländer, der seinen Asylantrag zurückgenommen hat, darf vor der Ausreise ein Aufenthaltstitel nach § 18a, § 18b oder § 19c Absatz 2 nur erteilt werden, wenn er vor dem 29. März 2023 eingereist ist; Gleiches gilt für die Erteilung einer Aufenthaltserlaubnis nach Maßgabe des Abschnitts 6 an den Ehegatten und das minderjährige ledige Kind des Ausländers.
