§ 52a AufenthV: Exemption and reduction in case of association entitlement
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
Who has "association rights"?
Do you have "association rights"? Then a special rule on fees applies to you.
You have association rights if the EU-Turkey Association Agreement applies to you. This right comes from an agreement. The agreement is called: Agreement of 12 September 1963 establishing an Association between the European Economic Community and Turkey. The agreement is published in the Federal Law Gazette (Bundesgesetzblatt) 1964, Part II, pages 509 and 510.
How high is the fee for your residence title?
For you, the fee rules from sections 44 to 50 generally apply. But there is an important exception for you.
For the following residence titles, the authority must only charge a special, lower fee:
- Residence titles under section 44 to section 45
- Residence titles under section 45c paragraph 1
- Residence titles under section 48 paragraph 1 sentence 1 number 15
The amount of this fee: the same amount as an identity card costs for German citizens.
Are you not yet 24 years old when your residence title is issued? Then the fee is lower. It is the same amount as the fee for an identity card for German citizens of your age.
There is one more special case. Is it about section 45b paragraph 2 or section 47 paragraph 1 number 11 — each together with section 44 or with section 44a? Then the fee is exactly 8 euros.
Which fees are you exempt from?
You do not have to pay some fees at all. The law exempts you from them.
You are exempt from these fees:
- The fee under section 45b paragraph 1.
- The fee under section 45b paragraph 2 in conjunction with section 45.
- The fee under section 47 paragraph 1 number 3.
- The fee under section 47 paragraph 1 number 8 to 10.
- The fee under section 47 paragraph 1 number 11 in conjunction with section 45.
- The fee under section 48 paragraph 1 sentence 1 number 3, 4, 8 and 10 to 12.
- The fee under section 48 paragraph 1 sentence 1 number 13 and 14 — but only if it is about changing or reissuing documents from section 48 paragraph 1 sentence 1 number 3, 4, 8 and 10 to 12.
This means: You do not have to pay anything for these fees. For all other fees from sections 44 to 50, the normal rule applies.
