§ 5 StAG: Acquisition by Declaration
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This section explains how you can become a German citizen through a declaration.
Who may make this declaration?
You may make this declaration if you were born after the Basic Law (Grundgesetz) came into force and belong to one of these four groups:
Group 1: You are the child of a German parent. However, you did not receive German citizenship through your birth.
Group 2: You are the child of a mother who lost German citizenship before your birth. She lost it because she married a foreigner.
Group 3: You had German citizenship through your birth. You lost it because a foreigner legitimized you with legal effect. This means: under German law, you were later recognized as a legitimate (marital) child (legitimation).
Group 4: You are a descendant of a person from Group 1, 2, or 3. A descendant is, for example, a child or grandchild.
Do you belong to one of these four groups? Then you receive German citizenship through your declaration — if you also meet the further conditions in the next section.
Further conditions for all four groups
These conditions apply equally to Group 1, Group 2, Group 3, AND Group 4:
You must have legal capacity to act yourself. This means: you may make legally significant declarations yourself. Or another person represents you legally, for example your parents.
Exception: You do NOT receive German citizenship through the declaration if one of these three cases applies:
- A court has given you a final conviction for one or more intentional criminal offenses, sentencing you to a prison term or juvenile sentence of two years or more.
- In your most recent final conviction, the court ordered preventive detention (Sicherungsverwahrung).
- There is a ground for exclusion under Section 11 of the Nationality Act (Staatsangehörigkeitsgesetz).
Further rules that also apply
The rules from Section 4 paragraph 1 sentence 2, Section 12a paragraphs 2 to 4, Section 33 paragraph 5, and Section 37 of this Act also apply accordingly to your declaration.
You may also make this declaration if, under the same conditions, you did not obtain legal status under Article 116 paragraph 1 of the Basic Law (Grundgesetz), or if you lost this legal status.
When you may NOT make this declaration
You may not make the declaration if one of these two cases applies to you:
Case 1: You already had German citizenship once before. Either right after your birth. Or you possessed it after you had lost it through legitimation with legal effect by a foreigner. But you gave up, lost, or renounced this citizenship again. Or: as a descendant of this person, you were only born after they gave up, lost, or renounced citizenship. Or you were adopted as a child after that.
Case 2: You could have obtained German citizenship under Section 4 paragraph 4 sentence 2 in conjunction with paragraph 1. But you did not obtain it. Or you can still obtain it.
By when you can make the declaration
You can only make this declaration within ten years after this Act comes into force. After that, it is no longer possible.
The confirmation
Do you receive German citizenship through your declaration? Then the authority must issue you a certificate about it.
