§ 25b AufenthG: Granting of Residence in Cases of Sustainable Integration

What is this about?
This section regulates a residence permit for people who have already lived in Germany for a long time. The requirement: you have integrated sustainably into the way of life in the Federal Republic of Germany.
Who does this apply to?
This section applies to you if one of two things is true for you:
- You hold toleration status (Duldung). This means: your obligation to leave the country is temporarily suspended.
- You hold a residence permit under Section 104c.
Are you guaranteed to get the residence permit?
The authority should grant you the residence permit if you meet the requirements below. This means: normally, you get it then too. Only in special exceptional cases can the authority decide differently. Some of the usual rules from Section 5 paragraph 1 number 1 and paragraph 2 do not apply to you.
These are the requirements you normally have to meet
There are five requirements. They generally apply, but not always without exception (see below "Exception for illness, disability, or age").
- Length of stay: You have lived continuously in Germany for at least six years — as a person with toleration status, as a person with permission to remain (Gestattung), or with a residence permit. Do you live together in the same household with a minor, unmarried child? Then four years is enough.
- Commitment and basic knowledge: You commit to the free democratic basic order of the Federal Republic of Germany. In addition, you have basic knowledge of the legal system, the social system, and the way of life in the federal territory.
- Livelihood: You secure your livelihood predominantly through your own employment. Or: your previous school, training, and income situation, as well as your family circumstances, lead to the expectation that you will secure your livelihood. Receiving housing benefit (Wohngeld) does not count against you here.
- German language skills: You have adequate spoken German language skills at level A2 of the Common European Framework of Reference for Languages.
- School attendance of children: Do you have children of compulsory school age? Then you must prove that they actually attend school.
Social benefits are sometimes not a problem
Are you temporarily receiving social benefits? This usually does not count against securing your livelihood (requirement 3) if one of the following four situations applies to you:
- You are studying at a state or state-recognized university. Or you are doing training in a recognized skilled trade or in a state-funded vocational preparation measure.
- You are part of a family with minor children that is temporarily dependent on supplementary social benefits.
- You are a single parent with minor children, and taking up work is not reasonable for you under Section 10 paragraph 1 number 3 of the Second Book of the Social Code (Sozialgesetzbuch).
- You care for close relatives in need of care.
When must the authority refuse?
The authority must refuse the residence permit in two cases. This is mandatory — there is no discretion here.
- You prevent or delay the ending of your stay. This happens, for example, through intentionally false statements, through deception about your identity or nationality, or because you fail to meet reasonable requirements to cooperate in removing obstacles to your departure.
- There is a deportation interest (Ausweisungsinteresse) within the meaning of Section 54 paragraph 1 or paragraph 2 numbers 1 and 2.
Exception for illness, disability, or age
Can you not meet requirements 3 (livelihood) and 4 (German language skills) because of a physical, mental, or psychological illness or disability? Or can you not meet them because of your age? Then these two requirements do not apply to you.
Family members
Does your spouse, your registered life partner, or a minor unmarried child live with you in a family unit? The authority should grant this person a residence permit too. This means: normally, they get one as well. For this, requirements 2 to 5 must be met — the requirement on length of stay (requirement 1) does not apply here. The rules on refusal, the exception for illness, and the rules on the validity period also apply to this person. In addition, Section 31 applies accordingly.
How long is the residence permit valid?
The authority must issue the residence permit for a maximum of two years. The same applies to an extension: a maximum of two years. This differs from the usual rule in Section 26 paragraph 1 sentence 1. The authority can also issue it in a way that differs from Section 10 paragraph 3 sentence 2 — this is a discretionary decision. Section 25a remains unaffected by this.
Special rule for 30 months of toleration status under Section 60d
Have you, your spouse, your registered life partner, or a minor unmarried child living with you in a family unit held a Duldung under Section 60d for 30 months? Then the authority should grant you the residence permit, even if the six-year or four-year period (requirement 1) has not yet been met. This means: normally, you get it anyway. Requirement: the conditions under Section 60d are met, and you have adequate spoken German language skills. Was there an opportunity to attend an integration course? Then, in addition, you, your spouse, or your registered life partner must have adequate written German language skills.
Crediting of periods under Section 104c
Do you hold a residence permit under Section 104c? Then the authority must also count the periods mentioned in Section 60b paragraph 5 sentence 1 when calculating your length of stay (requirement 1).
Special rule for holders of a residence permit under Section 104c
Do you have a residence permit under Section 104c? Then the authority should only grant you a residence permit under this section if the requirements of Section 5 paragraph 1 number 1a are met. This means: normally, you only get it under this condition. Have you taken the necessary and reasonable steps to clarify your identity? Then the authority can also grant the residence permit without this requirement — this is a discretionary decision.
(1) Einem Ausländer, der geduldet oder Inhaber einer Aufenthaltserlaubnis nach § 104c ist, soll abweichend von § 5 Absatz 1 Nummer 1 und Absatz 2 eine Aufenthaltserlaubnis erteilt werden, wenn er sich nachhaltig in die Lebensverhältnisse der Bundesrepublik Deutschland integriert hat. Dies setzt regelmäßig voraus, dass der Ausländer
- 1.sich seit mindestens sechs Jahren oder, falls er zusammen mit einem minderjährigen ledigen Kind in häuslicher Gemeinschaft lebt, seit mindestens vier Jahren ununterbrochen geduldet, gestattet oder mit einer Aufenthaltserlaubnis im Bundesgebiet aufgehalten hat,
- 2.sich zur freiheitlichen demokratischen Grundordnung der Bundesrepublik Deutschland bekennt und über Grundkenntnisse der Rechts- und Gesellschaftsordnung und der Lebensverhältnisse im Bundesgebiet verfügt,
- 3.seinen Lebensunterhalt überwiegend durch Erwerbstätigkeit sichert oder bei der Betrachtung der bisherigen Schul-, Ausbildungs-, Einkommens- sowie der familiären Lebenssituation zu erwarten ist, dass er seinen Lebensunterhalt im Sinne von § 2 Absatz 3 sichern wird, wobei der Bezug von Wohngeld unschädlich ist,
- 4.über hinreichende mündliche Deutschkenntnisse im Sinne des Niveaus A2 des Gemeinsamen Europäischen Referenzrahmens für Sprachen verfügt und
- 5.bei Kindern im schulpflichtigen Alter deren tatsächlichen Schulbesuch nachweist. Ein vorübergehender Bezug von Sozialleistungen ist für die Lebensunterhaltssicherung in der Regel unschädlich bei 1. Studierenden an einer staatlichen oder staatlich anerkannten Hochschule sowie Auszubildenden in anerkannten Lehrberufen oder in staatlich geförderten Berufsvorbereitungsmaßnahmen,
- 2.Familien mit minderjährigen Kindern, die vorübergehend auf ergänzende Sozialleistungen angewiesen sind,
- 3.Alleinerziehenden mit minderjährigen Kindern, denen eine Arbeitsaufnahme nach § 10 Absatz 1 Nummer 3 des Zweiten Buches Sozialgesetzbuch nicht zumutbar ist oder
- 4.Ausländern, die pflegebedürftige nahe Angehörige pflegen.
(2) Die Erteilung einer Aufenthaltserlaubnis nach Absatz 1 ist zu versagen, wenn
- 1.der Ausländer die Aufenthaltsbeendigung durch vorsätzlich falsche Angaben, durch Täuschung über die Identität oder Staatsangehörigkeit oder Nichterfüllung zumutbarer Anforderungen an die Mitwirkung bei der Beseitigung von Ausreisehindernissen verhindert oder verzögert oder
- 2.ein Ausweisungsinteresse im Sinne von § 54 Absatz 1 oder Absatz 2 Nummer 1 und 2 besteht.
(3) Von den Voraussetzungen des Absatzes 1 Satz 2 Nummer 3 und 4 wird abgesehen, wenn der Ausländer sie wegen einer körperlichen, geistigen oder seelischen Krankheit oder Behinderung oder aus Altersgründen nicht erfüllen kann.
(4) Dem Ehegatten, dem Lebenspartner und minderjährigen ledigen Kindern, die mit einem Begünstigten nach Absatz 1 in familiärer Lebensgemeinschaft leben, soll unter den Voraussetzungen des Absatzes 1 Satz 2 Nummer 2 bis 5 eine Aufenthaltserlaubnis erteilt werden. Die Absätze 2, 3 und 5 finden Anwendung. § 31 gilt entsprechend.
(5) Die Aufenthaltserlaubnis wird abweichend von § 26 Absatz 1 Satz 1 längstens für zwei Jahre erteilt und verlängert. Sie kann abweichend von § 10 Absatz 3 Satz 2 erteilt werden. § 25a bleibt unberührt.
(6) Einem Ausländer, seinem Ehegatten oder seinem Lebenspartner und in familiärer Lebensgemeinschaft lebenden minderjährigen ledigen Kindern, die seit 30 Monaten im Besitz einer Duldung nach § 60d sind, soll eine Aufenthaltserlaubnis nach Absatz 1 abweichend von der in Absatz 1 Satz 2 Nummer 1 genannten Frist erteilt werden, wenn die Voraussetzungen nach § 60d erfüllt sind und der Ausländer über hinreichende mündliche deutsche Sprachkenntnisse verfügt; bestand die Möglichkeit des Besuchs eines Integrationskurses, setzt die Erteilung der Aufenthaltserlaubnis zudem voraus, dass der Ausländer, sein Ehegatte oder sein Lebenspartner über hinreichende schriftliche Kenntnisse der deutschen Sprache verfügt.
(7) Besitzt der Ausländer eine Aufenthaltserlaubnis nach § 104c, sind für die Anwendung des Absatzes 1 Satz 2 Nummer 1 auch die in § 60b Absatz 5 Satz 1 genannten Zeiten anzurechnen.
(8) Einem Ausländer mit einer Aufenthaltserlaubnis nach § 104c soll eine Aufenthaltserlaubnis nach Absatz 1 nur erteilt werden, wenn die Voraussetzungen des § 5 Absatz 1 Nummer 1a erfüllt sind. Hat der Ausländer die erforderlichen und ihm zumutbaren Maßnahmen für die Identitätsklärung ergriffen, kann sie abweichend von Satz 1 erteilt werden.
