§ 25a AufenthG: Granting of Residence for Well-Integrated Young People and Young Adults
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
Who does this section apply to?
Are you a young person or a young adult? Do you have a residence permit under § 104c? Or have you held a toleration status (Duldung) for at least twelve months? Then this section is about your residence permit.
Paragraph 1: Residence permit for you
Do you meet all five of the following conditions? Then the authority should grant you a residence permit — as a rule you receive it, and only in exceptional cases can the authority decide differently.
These are the five conditions:
You have been continuously present in the federal territory for three years. This counts: with a permit, with a toleration status (Duldung), or with an Aufenthaltsgestattung.
As a rule, you have been successfully attending a school in the federal territory for three years. Or you have a recognized school-leaving certificate or vocational qualification. Exception: Can you not meet this condition because of a physical, mental, or psychological illness or disability? Then this condition does not apply to you.
You submit the application for the residence permit before you turn 27.
It must be clear: based on your education and living circumstances so far, you can fit into the living circumstances in Germany.
There must be no concrete indications that you do not commit to the free democratic basic order of the Federal Republic of Germany.
Note on public benefits: Are you currently doing school-based training, vocational training, or university study? Then you may still receive public benefits to secure your livelihood. This does not prevent the residence permit.
Important exception – here the authority must refuse: Is your deportation suspended only because you yourself gave false information? Or because you deceived the authorities about your identity or your nationality? Then the authority must refuse the residence permit.
Paragraph 2: Residence permit for your family
For parents or a parent with custody: Does your minor child have a residence permit under paragraph 1? Then you as a parent can also get a residence permit. The authority decides on a case-by-case basis. For this, both of the following conditions must be met:
Your deportation is not prevented or delayed by false information, by deception about your identity or nationality, or because you fail to meet reasonable requirements to remove obstacles to your departure.
Your livelihood is independently secured through employment.
For further minor children: Does a minor child live together with a parent who has a residence permit under the two conditions above? Do they live in a family unit? Then this child can also get a residence permit. The authority decides on a case-by-case basis.
For spouses and registered life partners: Do you live together with a person who has a residence permit under paragraph 1? Do you live in a family unit? And are the two conditions from above met (no prevention of deportation through deception, livelihood secured through employment)? Then the authority should also grant you a residence permit — as a rule you receive it too, and only in exceptional cases can the authority decide differently.
Note: § 31 of the Residence Act applies accordingly to these cases.
For minor, unmarried children: Does a minor, unmarried child live in a family unit with a person who has a residence permit under paragraph 1? Then the authority should also grant the child a residence permit — as a rule the child receives it too, and only in exceptional cases can the authority decide differently.
Paragraph 3: When the residence permit for the family is excluded
A residence permit under paragraph 2 is excluded if you were convicted of an intentional criminal offense that you committed in the federal territory.
Exception: Fines of up to a total of 50 daily rates are generally disregarded. Fines of up to 90 daily rates are also generally disregarded if they involve offenses that, under the Residence Act or the Asylum Act, can only be committed by foreign nationals.
Paragraph 4: Exception from § 10
The residence permit can be granted by way of exception from § 10 paragraph 3 sentence 2 of the Residence Act.
Paragraph 5: Crediting of periods for § 104c
Do you have a residence permit under § 104c? Then, for the three-year period from paragraph 1 number 1, the periods named in § 60b paragraph 5 sentence 1 of the Residence Act are also credited.
Paragraph 6: Special rule for § 104c
Do you have a residence permit under § 104c? Then the authority should grant you a residence permit under paragraph 1 only if the requirements of § 5 paragraph 1 number 1a of the Residence Act are met.
There is an exception: Have you taken the necessary and reasonable steps to clarify your identity? Then the authority can grant the residence permit even without this requirement. The authority decides on a case-by-case basis.
