§ 57 AufenthG: Refoulement

If you are apprehended in connection with an unauthorized entry across an external border, you shall normally be pushed back. This means: You are returned to the state from which you entered. An external border is a border within the meaning of Article 2 No. 2 of Regulation (EU) 2016/399.
You shall also be pushed back to another state in these cases:
- You are enforceably required to leave the country, and that state takes you back under an intergovernmental readmission agreement that was in force on 13 January 2009. This can be another EU state, Norway or Switzerland.
- The border authority encounters you near the border immediately after an unauthorized entry. And there are indications that another state is responsible for your asylum procedure, and a procedure to take you in or take you back is started.
When you are pushed back, the rules on the prohibition of deportation apply accordingly.
(1) Ein Ausländer, der in Verbindung mit der unerlaubten Einreise über eine Grenze im Sinne des Artikels 2 Nummer 2 der Verordnung (EU) 2016/399 (Außengrenze) aufgegriffen wird, soll zurückgeschoben werden.
(2) Ein vollziehbar ausreisepflichtiger Ausländer, der durch einen anderen Mitgliedstaat der Europäischen Union, Norwegen oder die Schweiz auf Grund einer am 13. Januar 2009 geltenden zwischenstaatlichen Übernahmevereinbarung wieder aufgenommen wird, soll in diesen Staat zurückgeschoben werden; Gleiches gilt, wenn der Ausländer von der Grenzbehörde im grenznahen Raum in unmittelbarem zeitlichen Zusammenhang mit einer unerlaubten Einreise angetroffen wird und Anhaltspunkte dafür vorliegen, dass ein anderer Staat auf Grund von Rechtsvorschriften der Europäischen Union oder eines völkerrechtlichen Vertrages für die Durchführung des Asylverfahrens zuständig ist und ein Auf- oder Wiederaufnahmeverfahren eingeleitet wird.
(3) § 58 Absatz 1b, § 59 Absatz 8, § 60 Absatz 1 bis 5 und 7 bis 9, die §§ 62 und 62a sind entsprechend anzuwenden.
