§ 61 AufenthG: Territorial Restriction, Residence Obligation, Departure Facilities
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
Spatial Restriction, Residence Condition, Departure Facilities
This section applies if you are enforceably required to leave the country. This means: you must leave Germany, and there is no legal remedy left that can stop the departure.
Spatial restriction to a federal state
Your stay is spatially restricted. You may only stay in a specific federal state.
The authority may deviate from this restriction, at its discretion. This means: you can leave the federal state in certain cases, but this is not a guarantee — the authority decides. These cases are:
- You may work without the Federal Employment Agency (Bundesagentur für Arbeit) checking your employment under Section 39 (2) sentence 1 number 1.
- You attend a school, are doing vocational training or further training at a company, or you are studying at a state or state-recognized university or a comparable training institution — and the trip is necessary for this.
- It serves to keep your family together.
Special case: deportation notice with no known authority
If your case falls under Section 60a (2a), your stay is restricted to the district of the immigration authority (Ausländerbehörde) that was last responsible for you within Germany. You must go there without delay after your entry.
If this authority cannot be determined, Section 15a applies accordingly. This means: the authority then applies the rules from Section 15a as if they had been made specifically for your case.
End of the restriction after three months
The spatial restriction from the two previous sections ends automatically once you have held permission, toleration status (Duldung), or an Aufenthaltsgestattung (permission to stay while your asylum procedure is pending) continuously in Germany for three months.
Additional spatial restriction in special cases
Regardless of the rules mentioned so far, the authority may order a spatial restriction, at its discretion, if one of these three points applies:
- You have been finally convicted of a criminal offense. Exception: offenses that only a foreigner can commit do not count here.
- There are facts that allow the conclusion that you have violated the Narcotics Act (Betäubungsmittelgesetz).
- Concrete measures to end your stay are imminent.
There is another, separate case: the authority should, as a rule, order a restriction to the district of the immigration authority (Ausländerbehörde) if you yourself have created the reasons that prevent your deportation. This is the case, for example, if you have intentionally given false information or deceived the authority about your identity or nationality. It also applies if you fail to fulfill reasonable duties to cooperate in removing obstacles to your departure. This means: as a rule, the authority then orders the restriction. Only in special exceptional cases can it be different.
Residence condition
If your subsistence is not secured and you are enforceably required to leave the country, you must live at a specific place. This is called a residence condition (Wohnsitzauflage).
If the immigration authority (Ausländerbehörde) has not determined otherwise, this applies: your place of residence is the place where you were living when the decision was made on the temporary suspension of your deportation.
The immigration authority may change the residence condition — on its own initiative (this means: you do not need to apply for this separately) or because you have applied for it. In doing so, the authority must take into account: whether family members live together in one household, and other humanitarian reasons of comparable weight.
You may temporarily leave the place specified in the residence condition without needing permission to do so.
Further conditions when the end of your stay is imminent
If concrete measures to end your stay are imminent, the authority may order further conditions. This is meant to secure and enforce your obligation to leave the country. For example, the authority may require you to report to the immigration authority responsible for your place of residence once a week or at longer intervals.
The authority may also order further terms and conditions.
Departure facilities of the federal states
The federal states may set up their own departure facilities for foreign nationals who are enforceably required to leave the country. This is not an obligation — each federal state decides for itself whether to do so.
In these facilities, your willingness to leave voluntarily should, as a rule, be promoted through support and counseling. This is usually how it works; only in exceptional cases can it be different. It should also be ensured that authorities and courts can reach you and that your departure can be carried out.
