Obligation to Attend an Integration Course (§ 44a AufenthG)
Some people have to attend an integration course. This section explains when that obligation applies.
When are you obliged to attend?
You are obliged if one of these points applies to you:
- You are entitled under § 44 and cannot yet communicate in German at least in a simple way.
- You are entitled under § 44 and did not have sufficient German language skills when your residence permit was issued under § 23 para. 2, § 28 para. 1 sentence 1 no. 1, § 30 or § 36a para. 1 sentence 1 first alternative.
- You receive benefits under Social Code Book II (Zweites Buch Sozialgesetzbuch) and the basic income support provider obliges you under § 15a para. 1 sentence 1 no. 3 of that book.
- You have a particular need for integration and the immigration authority (Ausländerbehörde) requests you to attend.
- You belong to the group named in § 44 para. 4 sentence 2 nos. 1 to 3, receive benefits under the Asylum Seekers' Benefits Act (Asylbewerberleistungsgesetz) and the benefits authority requests you to attend.
For the first two points, the immigration authority establishes the obligation when it issues your residence permit.
The role of the job centre
In the cases of points 1, 2 and 4, the basic income support provider should as a rule follow the obligation imposed by the immigration authority. This concerns the measures under §§ 15 and 15a of Social Code Book II. If the provider decides otherwise in an individual case, it informs the immigration authority, which then revokes the obligation. It is also revoked if, alongside your work, even a part-time course cannot reasonably be expected of you.
In addition, the immigration authorities can oblige you if you hold a residence permit under § 25 para. 1 or 2. This is possible if you can only communicate in German in a simple way.
The obligation from points 1 and 2 ends only once you have properly attended the integration course. Apart from that, it ends through withdrawal or revocation.
Who is exempt?
You do not have to attend if you:
- are doing vocational or other training in Germany,
- can prove that you attend a comparable educational programme in Germany,
- cannot attend permanently or attendance cannot reasonably be expected of you.
You are exempt from the orientation course if you hold a residence permit under § 38a. For this you have to prove that you already took part in integration measures in another EU State to obtain long-term resident status.
What happens if you breach the obligation?
If you fail to attend for reasons you are responsible for, or if you do not pass the final test, the immigration authority points out the possible consequences to you. This happens before your residence permit is extended (§ 8 para. 3, § 9 para. 2 sentence 1 nos. 7 and 8, § 9a para. 2 sentence 1 nos. 3 and 4).
The immigration authority can use administrative coercion (Verwaltungszwang) to make you attend. It can also charge the expected cost contribution in advance as a single sum by means of a fee notice (Gebührenbescheid).
