What is this section about?
This section describes the accelerated skilled worker procedure. This is a faster procedure that makes it easier for a skilled worker from abroad to get a residence title.
Who can apply for the procedure?
An employer in Germany can apply for the accelerated procedure at the responsible immigration authority. This applies if the skilled worker wants to enter Germany for one of these purposes: section 16a, section 16d, section 18a, section 18b, section 18c paragraph 3, or section 18g of the Residence Act.
The employer needs a power of attorney from the skilled worker for this. This means: the skilled worker must authorize the employer to do this.
The employer may also instruct other people to carry out the procedure on their behalf.
The agreement between employer and authority
The employer and the immigration authority must conclude an agreement for this. It must contain in particular:
- The contact details of the skilled worker, the employer, and the authority.
- The employer's assurance that the skilled worker has authorized them. If necessary, the employer may also authorize further people themselves (sub-authorization).
- The employer's authorization of the immigration authority. This may allow the authority to initiate and carry out the procedure for recognizing the professional qualification obtained abroad.
- The employer's obligation to work toward ensuring that the skilled worker fulfils their duty to cooperate. This duty of the skilled worker is set out in section 82 paragraph 1 sentence 1 of the Residence Act.
- Which evidence must be submitted.
- A description of the procedures. This includes who is involved and which deadlines apply.
- The employer's duty to cooperate under section 4a paragraph 5 sentence 3 number 3 of the Residence Act.
- What happens if someone does not comply with the agreement.
What must the immigration authority do in the accelerated procedure?
In the accelerated procedure, the immigration authority has several tasks. These are obligations, not voluntary services. The authority must:
- advise the employer on the procedure and on the necessary evidence,
- if necessary, initiate the procedure for recognizing the foreign professional qualification with the responsible body. This also applies to the assessment of a foreign university degree certificate. The authority points out the accelerated procedure while doing so,
- if necessary, initiate the procedure with a competent body in Germany that confirms that the skilled worker either a) has a foreign professional qualification that is officially recognized in the country of origin and that required training of at least two years, or b) has a university degree that is officially recognized in the country of origin,
- as soon as such a recognition procedure is under way: forward the confirmations of receipt and completeness of the documents to the employer without undue delay. If the responsible body requests further evidence, or if the responsible body's decision arrives, the authority must invite the employer within three working days. At this appointment, the employer receives the documents and discusses the further procedure,
- if necessary, obtain the approval of the Federal Employment Agency, pointing out the accelerated procedure,
- inform the responsible foreign mission that the skilled worker will soon apply for a visa,
- give advance approval to the issuing of the visa without undue delay, as soon as all requirements are met. This includes the recognition or comparability of the professional qualification and the approval of the Federal Employment Agency.
If the skilled worker should work in Germany in an occupation that requires a special permit (a so-called regulated profession), the authority must additionally obtain this permit to practise the profession.
If the qualification is not equivalent
Sometimes the responsible body determines in a decision: the professional qualification obtained abroad is not equivalent to a German qualification. But if equivalence can be achieved through a qualification measure, then the accelerated procedure may continue. The aim is then entry for the purpose under section 16d of the Residence Act.
Family members
The accelerated procedure also covers family reunification. This applies to the spouse and to minor, unmarried children of the skilled worker. Requirement: their visa applications must be submitted in close time connection with the skilled worker's application.
Who else does this apply to?
Paragraphs 1 to 4 also apply to other qualified employees.
