§ 26 AufenthG: Duration of Residence

How long is your residence permit valid?
In the normal case, the authority may grant you a residence permit for at most three years. The authority may also extend it for at most three years. This is a discretionary decision by the authority. It is not a guarantee.
Special case: In cases under Section 25 (4) sentence 1 and (5) of the Residence Act, the maximum duration is shorter. There, the rule is: at most six months. This applies as long as you have not yet lived lawfully in the federal territory for at least 18 months.
In cases under Section 25 (1) sentence 1 and (2) sentences 1 and 2 of the Residence Act, you have a legal entitlement to three years. The authority must then grant you the residence permit for three years.
Do you meet the requirements of Section 25 (3) of the Residence Act? Then the authority must grant you the residence permit for at least one year. This is also a legal entitlement, not a discretionary decision.
For residence permits under Section 25 (4a) sentence 1 and (4b), the rule is: they are granted and extended for one year at a time. For residence permits under Section 25 (4a) sentence 3, the rule is: they are granted and extended for two years at a time. In justified individual cases, the authority may set a longer period of validity.
When must the authority not extend your residence permit?
Sometimes there is a reason why you cannot leave the country, or another reason against ending your stay. Does this reason no longer apply? Then the authority must not extend your residence permit. This is prohibited.
Settlement permit after five years: You have a legal entitlement to it
Do you hold a residence permit under Section 25 (1) or (2) sentence 1 of the Residence Act? Then the authority must grant you a settlement permit if you meet ALL of the following conditions. This is then not at the authority's discretion. You then have a legal entitlement to it.
- You have held the residence permit for five years. The time of your asylum procedure before the residence permit is counted toward this. This applies as an exception to Section 55 (3) of the Asylum Act.
- The Federal Office for Migration and Refugees has not notified the authority under Section 73b (3) of the Asylum Act that the requirements for a withdrawal, a revocation, or a rescission are met.
- Your livelihood is predominantly secured.
- You have sufficient knowledge of the German language.
- You also meet the requirements of Section 9 (2) sentence 1 numbers 4 to 6, 8 and 9 of the Residence Act.
Note: In addition, Section 9 (2) sentences 2 to 6, Section 9 (3) sentence 1, and Section 9 (4) of the Residence Act apply accordingly.
Exception for condition 3: Have you reached the standard retirement age under Section 35 sentence 2 or Section 235 (2) of Book Six of the Social Code? Then you do not need to meet condition 3 (predominantly secured livelihood).
Settlement permit after just three years: Stricter conditions
There is an exception to the five-year rule. Do you hold a residence permit under Section 25 (1) or (2) sentence 1 of the Residence Act? Then the authority must grant you a settlement permit after just three years if you meet ALL of the following conditions. This, too, is a legal entitlement, not a discretionary decision.
- You have held the residence permit for three years. The time of your asylum procedure before the residence permit is counted toward this. This applies as an exception to Section 55 (3) of the Asylum Act.
- The Federal Office for Migration and Refugees has not notified the authority under Section 73b (3) of the Asylum Act that the requirements for a revocation or a rescission are met.
- You have a good command of the German language.
- Your livelihood is very largely secured.
- You also meet the requirements of Section 9 (2) sentence 1 numbers 4 to 6, 8 and 9 of the Residence Act.
Note: Under this three-year rule, conditions 3 and 4 are worded more strictly than under the five-year rule. Under the five-year rule, sufficient language skills and a predominantly secured livelihood are enough. Under this three-year rule, you must have a good command of the German language, and your livelihood must be very largely secured.
Note: Under this three-year rule, only Section 9 (3) sentence 1 and Section 9 (4) of the Residence Act apply accordingly.
Did you enter Germany before your 18th birthday? Then the authority may apply Section 35 of the Residence Act to you accordingly. This is a discretionary decision by the authority.
These rules on the five-year and three-year settlement permit also apply to you if you hold a residence permit under Section 23 (4) of the Residence Act. Exception: Do the requirements for a rescission apply to you? Then these rules do not apply to you.
All other cases: The authority decides
Do you hold a residence permit under this section of the Residence Act without any of the cases described above applying to you? Then the authority may still grant you a settlement permit if you meet the requirements of Section 9 (2) sentence 1 of the Residence Act. This is a discretionary decision by the authority. You have no legal entitlement to it.
Note: Here too, Section 9 (2) sentences 2 to 6 of the Residence Act apply accordingly.
The time of your asylum procedure before the residence permit is counted toward this period. This applies as an exception to Section 55 (3) of the Asylum Act.
Did you enter Germany before your 18th birthday? Then here too, the authority may apply Section 35 of the Residence Act to you accordingly.
(1) Die Aufenthaltserlaubnis nach diesem Abschnitt kann für jeweils längstens drei Jahre erteilt und verlängert werden, in den Fällen des § 25 Abs. 4 Satz 1 und Abs. 5 jedoch für längstens sechs Monate, solange sich der Ausländer noch nicht mindestens 18 Monate rechtmäßig im Bundesgebiet aufgehalten hat. In den Fällen des § 25 Absatz 1 Satz 1 sowie Absatz 2 Satz 1 und 2 wird die Aufenthaltserlaubnis für drei Jahre erteilt. Ausländern, die die Voraussetzungen des § 25 Absatz 3 erfüllen, wird die Aufenthaltserlaubnis für mindestens ein Jahr erteilt. Die Aufenthaltserlaubnisse nach § 25 Absatz 4a Satz 1 und Absatz 4b werden jeweils für ein Jahr, Aufenthaltserlaubnisse nach § 25 Absatz 4a Satz 3 jeweils für zwei Jahre erteilt und verlängert; in begründeten Einzelfällen ist eine längere Geltungsdauer zulässig.
(2) Die Aufenthaltserlaubnis darf nicht verlängert werden, wenn das Ausreisehindernis oder die sonstigen einer Aufenthaltsbeendigung entgegenstehenden Gründe entfallen sind.
(3) Einem Ausländer, der eine Aufenthaltserlaubnis nach § 25 Absatz 1 oder 2 Satz 1 besitzt, ist eine Niederlassungserlaubnis zu erteilen, wenn
- 1.er die Aufenthaltserlaubnis seit fünf Jahren besitzt, wobei die Aufenthaltszeit des der Erteilung der Aufenthaltserlaubnis vorangegangenen Asylverfahrens abweichend von § 55 Absatz 3 des Asylgesetzes auf die für die Erteilung der Niederlassungserlaubnis erforderliche Zeit des Besitzes einer Aufenthaltserlaubnis angerechnet wird,
- 2.das Bundesamt für Migration und Flüchtlinge nicht nach § 73b Absatz 3 des Asylgesetzes mitgeteilt hat, dass die Voraussetzungen für den Entzug, den Widerruf oder die Rücknahme vorliegen,
- 3.sein Lebensunterhalt überwiegend gesichert ist,
- 4.er über hinreichende Kenntnisse der deutschen Sprache verfügt und
- 5.die Voraussetzungen des § 9 Absatz 2 Satz 1 Nummer 4 bis 6, 8 und 9 vorliegen. § 9 Absatz 2 Satz 2 bis 6, § 9 Absatz 3 Satz 1 und § 9 Absatz 4 finden entsprechend Anwendung; von der Voraussetzung in Satz 1 Nummer 3 wird auch abgesehen, wenn der Ausländer die Regelaltersgrenze nach § 35 Satz 2 oder § 235 Absatz 2 des Sechsten Buches Sozialgesetzbuch erreicht hat. Abweichend von Satz 1 und 2 ist einem Ausländer, der eine Aufenthaltserlaubnis nach § 25 Absatz 1 oder 2 Satz 1 besitzt, eine Niederlassungserlaubnis zu erteilen, wenn 1. er die Aufenthaltserlaubnis seit drei Jahren besitzt, wobei die Aufenthaltszeit des der Erteilung der Aufenthaltserlaubnis vorangegangenen Asylverfahrens abweichend von § 55 Absatz 3 des Asylgesetzes auf die für die Erteilung der Niederlassungserlaubnis erforderliche Zeit des Besitzes einer Aufenthaltserlaubnis angerechnet wird,
- 2.das Bundesamt für Migration und Flüchtlinge nicht nach § 73b Absatz 3 des Asylgesetzes mitgeteilt hat, dass die Voraussetzungen für den Widerruf oder die Rücknahme vorliegen,
- 3.er die deutsche Sprache beherrscht,
- 4.sein Lebensunterhalt weit überwiegend gesichert ist und
- 5.die Voraussetzungen des § 9 Absatz 2 Satz 1 Nummer 4 bis 6, 8 und 9 vorliegen. In den Fällen des Satzes 3 finden § 9 Absatz 3 Satz 1 und § 9 Absatz 4 entsprechend Anwendung. Für Kinder, die vor Vollendung des 18. Lebensjahres nach Deutschland eingereist sind, kann § 35 entsprechend angewandt werden. Die Sätze 1 bis 5 gelten auch für einen Ausländer, der eine Aufenthaltserlaubnis nach § 23 Absatz 4 besitzt, es sei denn, es liegen die Voraussetzungen für eine Rücknahme vor.
(4) Im Übrigen kann einem Ausländer, der eine Aufenthaltserlaubnis nach diesem Abschnitt besitzt, eine Niederlassungserlaubnis erteilt werden, wenn die in § 9 Abs. 2 Satz 1 bezeichneten Voraussetzungen vorliegen. § 9 Abs. 2 Satz 2 bis 6 gilt entsprechend. Die Aufenthaltszeit des der Erteilung der Aufenthaltserlaubnis vorangegangenen Asylverfahrens wird abweichend von § 55 Abs. 3 des Asylgesetzes auf die Frist angerechnet. Für Kinder, die vor Vollendung des 18. Lebensjahres nach Deutschland eingereist sind, kann § 35 entsprechend angewandt werden.
