§ 44 Residence Act: Participation in an Integration Course
When do you have a right to an integration course? You live permanently in Germany. You receive a certain residence permit or residence title for the first time. Then you have a right to participate once in an integration course. This is a legal entitlement. The authority must enable your participation.
These residence permits and residence titles give you this right, if you receive them for the first time:
- A residence permit for gainful employment, meaning to work. This is based on sections 18a to 18d, 18g, 19c or 21 of the Residence Act.
- A residence permit for family reunification. This is based on sections 28, 29, 30, 32, 36 or 36a of the Residence Act.
- A residence permit on humanitarian grounds. This is based on section 25 paragraph 1, paragraph 2, paragraph 4a sentence 3, or section 25b of the Residence Act.
- A residence permit as a long-term resident. This is based on section 38a of the Residence Act.
- A residence title under section 23 paragraph 2 or paragraph 4 of the Residence Act.
What does "permanent stay" mean? As a rule, your stay counts as permanent if you receive a residence permit for at least one year. Your stay also counts as permanent if you have held a residence permit for more than 18 months. This does not apply if your stay is only temporary. This means: only in such exceptional cases does your stay still not count as permanent.
How long does your right to participate last? Your right to participate expires one year after the residence title that gave you this right was granted. Your right also expires if this residence title ceases to apply. There is one exception: if you were unable to register for an integration course in time through no fault of your own, your right remains in place.
When do you have no right to participate? There are three cases where you have no right to an integration course:
- You are a child, adolescent, or young adult. You are starting school-based education or continuing your existing schooling in Germany.
- You clearly have a low need for integration.
- You already speak sufficient German. Important for the third case: even without a right to the integration course, your right to the orientation course remains in place.
Can you participate even without this right? If you have no right, or no longer have a right, to participate, you can still be admitted. This is only possible if free course places are still available. The authority decides this at its own discretion. This is not a guarantee of a place.
This rule also applies to German citizens. The requirement is: they cannot speak sufficient German. And they have a particular need for integration.
This rule also applies to foreign nationals in the following situations:
- You have an Aufenthaltsgestattung (permit to stay during an asylum procedure). This is the certificate issued during an asylum procedure.
- You have a toleration status (Duldung) under section 60a paragraph 2 sentence 3 of the Residence Act.
- You have a residence permit under section 24 or section 25 paragraph 5 of the Residence Act.
In this case too, you can be admitted within the framework of free course places. Here too, the authority decides at its own discretion.
