Administrative Procedure
The rules on administrative procedure in this law must not be deviated from by state law. This applies to the provisions on data transmission, data comparison, and authorisation to issue regulations.
Exception: State law may deviate for procedures relating to residence rights under Section 3a and Sections 12a and 16.
Von den in § 11 Abs. 1 in Verbindung mit § 87 Absatz 1, 2 Satz 1 und 2, Absatz 4 Satz 1, 3 und 5, §§ 90, 91 Abs. 1 und 2, § 99 Abs. 1 und 2 des Aufenthaltsgesetzes getroffenen Regelungen des Verwaltungsverfahrens kann durch Landesrecht nicht abgewichen werden. Dies gilt nicht im Hinblick auf Verfahren im Zusammenhang mit Aufenthaltsrechten nach § 3a und mit den in den §§ 12a und 16 geregelten Aufenthaltsrechten.
