§ 32 BeschV: Employment of persons with toleration status or provisional residence permit
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This rule applies to you if you have a toleration status (Duldung) or an Aufenthaltsgestattung.
When can you get approval to work?
You have a toleration status (Duldung). You have been living in Germany lawfully, with a toleration status, or with an Aufenthaltsgestattung for three months. Then the authority can give you approval to work. Note: This is a discretionary decision. The authority decides on a case-by-case basis. You do not have a fixed legal entitlement to it.
Several additional rules from the Residence Act also apply to this approval: sections 39, 40 paragraph 1 number 1 and paragraph 2, as well as section 41. The authority applies these rules to you in the same way.
When do you not need approval?
In five cases, you do not need the authority's approval to get permission to work:
For an internship that is exempt from the minimum wage under section 22 paragraph 1 sentence 2 numbers 1 to 4 of the Minimum Wage Act.
For vocational training in a state-recognized training occupation. This also applies to a comparably regulated training occupation.
For employment that is already regulated in other sections. These are: section 18c paragraph 3 and section 18g paragraph 1 sentence 1 of the Residence Act, as well as section 5, section 14 paragraphs 1 and 1a, section 15 number 2, section 22 numbers 3 to 6, and section 23 of this Ordinance.
For work with your spouse or your registered life partner. This also applies to relatives in the first degree and relatives by marriage in the first degree. This person is then your employer. You live together with this person in one household.
For any work: if you had an uninterrupted four-year stay in Germany. This stay was lawful, with a toleration status, or possible through an Aufenthaltsgestattung.
These five rules also apply to you if you have an Aufenthaltsgestattung instead of a toleration status.
