This section says: Some activities do not count as employment.
The law treats these activities as if you were not employed within the meaning of the Residence Act. This means: For these activities, the employment rules of the Residence Act do not apply.
There are four groups of such activities.
Group 1 These are activities under section 3 number 1 and number 2 of the Employment Ordinance (Beschäftigungsverordnung). These activities do not count as employment even if you do not have approval for them. This also includes activities under section 16 of the Employment Ordinance. This also includes activities under section 29 paragraph 5 sentence 2 of the Employment Ordinance. This rule applies only for a maximum of 90 days. You count these 90 days within a period of 180 days.
Group 2 These are activities under section 5, section 14, section 15, section 17 and section 18 of the Employment Ordinance. This also includes activities under section 19 paragraph 1 of the Employment Ordinance. This also includes activities under section 20, section 22, section 23 and section 24b of the Employment Ordinance. This rule applies only for a maximum of 90 days. You count these 90 days within a period of twelve months.
Group 3 These are activities under section 21 of the Employment Ordinance. This rule applies to foreign nationals with a special status. These persons hold the legal status of a long-term resident in another member state of the European Union. This rule applies only for a maximum of 90 days. You count these 90 days within a period of twelve months.
Group 4 These are activities of certain persons. These persons are exempt from the requirement of a residence title under section 23 to section 30 of the Residence Ordinance (Aufenthaltsverordnung). This means: These persons do not need a residence title for these activities.
Note: The exact requirements for each group are set out in the sections named above. Check there if you want to know whether your activity belongs to one of these groups.
