§ 29 Residence Act: Family Reunification with Foreign Nationals
This section explains: When may your family join you in Germany? You are yourself a foreign national in Germany.
The Basic Rule
For family reunification, two things must be met together.
First: You must hold a specific residence title. These titles count:
- a settlement permit,
- a permit for permanent residence – EU,
- a residence permit,
- an EU Blue Card,
- an ICT Card,
- or a Mobile ICT Card.
It is also sufficient if you are lawfully staying in Germany under § 18e of the Residence Act.
Second: You must have sufficient living space. This means: Your home must be large enough for your family.
Both conditions must be met.
Exception for Certain Holders of the EU Blue Card
In a special case, three rules do not apply:
- the requirement of sufficient living space from the section above,
- a rule from § 5 paragraph 1 number 1 of the Residence Act (except the rule on health insurance coverage — that still applies),
- and a rule from § 27 paragraph 3 sentence 1 of the Residence Act.
This exception applies only if ALL three of the following conditions are met:
- The family is joining a person who holds an EU Blue Card.
- This person already held an EU Blue Card before. This earlier EU Blue Card came from another Member State of the European Union.
- The family has already lived together in this other Member State.
Spouse and Child under Certain Protection Titles
This rule applies to the spouse and to the minor, unmarried child of a foreign national. The foreign national must hold one of these titles:
- a residence permit under § 23 paragraph 4,
- a residence permit under § 25 paragraph 1 or paragraph 2,
- a settlement permit under § 26 paragraph 3,
- or a settlement permit under § 26 paragraph 4 (if a residence permit under § 25 paragraph 2 sentence 2 existed before).
The authority may waive two conditions:
- a rule from § 5 paragraph 1 number 1 of the Residence Act,
- and the requirement of sufficient living space from the first section above.
This is discretionary. The authority decides on a case-by-case basis. It is not a guarantee.
The authority SHOULD, however, waive these conditions if both of the following points apply. This means: as a rule, the authority does waive the conditions then — only in specially justified exceptional cases does it not.
- The application for the residence title for family reunification is submitted within three months. The three-month period begins with one of these three events:
- Your recognition as entitled to asylum becomes unappealable.
- Your refugee status or your subsidiary protection is unappealably granted.
- You receive a residence permit under § 23 paragraph 4.
- There is no other way to live together with the family. There is indeed a country outside the European Union to which the foreign national or their family has a special connection. But living together there is not possible.
Important: The three-month period is also considered met if the foreign national submits an application in time themself.
Restricted Reunification under Certain Humanitarian Titles
This rule applies to the spouse and the minor child of a foreign national. The foreign national must hold one of these titles:
- a residence permit under § 22,
- a residence permit under § 23 paragraph 1 or paragraph 2,
- a residence permit under § 25 paragraph 3,
- a residence permit under § 25 paragraph 4a sentence 1,
- a residence permit under § 25a paragraph 1,
- or a residence permit under § 25b paragraph 1.
Here, the residence permit for the family may ONLY be granted for one of these three reasons:
- for reasons under international law,
- for humanitarian reasons,
- or to safeguard the political interests of the Federal Republic of Germany.
Other reasons are not sufficient here. This is a narrow exception, not the standard case.
§ 26 paragraph 4 of the Residence Act applies here accordingly.
In certain cases, family reunification is completely excluded. This applies to foreign nationals with a title under:
- § 25 paragraph 4,
- § 25 paragraph 4b,
- § 25 paragraph 5,
- § 25a paragraph 2,
- § 25b paragraph 4,
- § 104a paragraph 1 sentence 1,
- § 104b,
- or § 104c.
In these cases, no family reunification is granted.
Family Reunification under Temporary Protection
Have you been granted temporary protection under § 24 paragraph 1? Then the authority MUST grant your spouse and your minor, unmarried child a residence permit. The minor, unmarried child of your spouse also receives the residence permit. The rules from § 5 paragraph 1 and § 27 paragraph 3 of the Residence Act do not apply here.
This applies only if both of the following conditions are met:
- The situation of flight has broken up the family life in the country of origin.
- One of two situations applies:
- The family member is being taken over from another Member State of the European Union.
- Or: They are located outside the European Union and are in need of protection.
For other family members — not the spouse or minor child — § 36 of the Residence Act applies instead.
§ 24 of the Residence Act is applied to family members admitted under this rule.
No Living-Space Requirement for Certain Residence Titles
This rule applies to the spouse or the minor, unmarried child of a foreign national. The foreign national must hold one of these titles:
- an EU Blue Card,
- an ICT Card,
- a Mobile ICT Card,
- a residence title under § 18a,
- a residence title under § 18b,
- a residence title under § 18c paragraph 3,
- a residence title under § 18d,
- a residence title under § 18f,
- a residence title under § 19c paragraph 1 (for employment as a senior executive, as a manager, as a company specialist, as a scientist, as a guest scientist, as an engineer or technician on the research team of a guest scientist, or as a teacher),
- a residence title under § 19c paragraph 2,
- a residence title under § 19c paragraph 4 sentence 1,
- or a residence title under § 21.
In these cases, the requirement of sufficient living space is waived. This requirement is stated in the "The Basic Rule" section above.
(1) Für den Familiennachzug zu einem Ausländer muss
- 1.der Ausländer eine Niederlassungserlaubnis, Erlaubnis zum Daueraufenthalt – EU, Aufenthaltserlaubnis, eine Blaue Karte EU, eine ICT-Karte oder eine Mobiler-ICT-Karte besitzen oder sich gemäß § 18e berechtigt im Bundesgebiet aufhalten und
- 2.ausreichender Wohnraum zur Verfügung stehen. Satz 1 Nummer 2, § 5 Absatz 1 Nummer 1 mit Ausnahme des Bestehens ausreichenden Krankenversicherungsschutzes sowie § 27 Absatz 3 Satz 1 finden keine Anwendung, wenn 1. der Familiennachzug zu einem Inhaber einer Blauen Karte EU erfolgen soll,
- 2.der Inhaber der Blauen Karte EU unmittelbar vor der Erteilung der Blauen Karte EU im Besitz einer Blauen Karte EU war, die ein anderer Mitgliedstaat der Europäischen Union ausgestellt hat, und
- 3.die familiäre Lebensgemeinschaft bereits in dem anderen Mitgliedstaat der Europäischen Union bestand.
(2) Bei dem Ehegatten und dem minderjährigen ledigen Kind eines Ausländers, der eine Aufenthaltserlaubnis nach § 23 Absatz 4, § 25 Absatz 1 oder 2, eine Niederlassungserlaubnis nach § 26 Absatz 3 oder nach Erteilung einer Aufenthaltserlaubnis nach § 25 Absatz 2 Satz 2 eine Niederlassungserlaubnis nach § 26 Absatz 4 besitzt, kann von den Voraussetzungen des § 5 Absatz 1 Nummer 1 und des Absatzes 1 Nummer 2 abgesehen werden. In den Fällen des Satzes 1 ist von diesen Voraussetzungen abzusehen, wenn
- 1.der im Zuge des Familiennachzugs erforderliche Antrag auf Erteilung eines Aufenthaltstitels innerhalb von drei Monaten nach unanfechtbarer Anerkennung als Asylberechtigter oder unanfechtbarer Zuerkennung der Flüchtlingseigenschaft oder subsidiären Schutzes oder nach Erteilung einer Aufenthaltserlaubnis nach § 23 Absatz 4 gestellt wird und
- 2.die Herstellung der familiären Lebensgemeinschaft in einem Staat, der nicht Mitgliedstaat der Europäischen Union ist und zu dem der Ausländer oder seine Familienangehörigen eine besondere Bindung haben, nicht möglich ist. Die in Satz 2 Nr. 1 genannte Frist wird auch durch die rechtzeitige Antragstellung des Ausländers gewahrt.
(3) Die Aufenthaltserlaubnis darf dem Ehegatten und dem minderjährigen Kind eines Ausländers, der eine Aufenthaltserlaubnis nach den §§ 22, 23 Absatz 1 oder Absatz 2 oder § 25 Absatz 3 oder Absatz 4a Satz 1, § 25a Absatz 1 oder § 25b Absatz 1 besitzt, nur aus völkerrechtlichen oder humanitären Gründen oder zur Wahrung politischer Interessen der Bundesrepublik Deutschland erteilt werden. § 26 Abs. 4 gilt entsprechend. Ein Familiennachzug wird in den Fällen des § 25 Absatz 4, 4b und 5, § 25a Absatz 2, § 25b Absatz 4, § 104a Abs. 1 Satz 1, § 104b und § 104c nicht gewährt.
(4) Die Aufenthaltserlaubnis wird dem Ehegatten und dem minderjährigen ledigen Kind eines Ausländers oder dem minderjährigen ledigen Kind seines Ehegatten abweichend von § 5 Abs. 1 und § 27 Abs. 3 erteilt, wenn dem Ausländer vorübergehender Schutz nach § 24 Abs. 1 gewährt wurde und
- 1.die familiäre Lebensgemeinschaft im Herkunftsland durch die Fluchtsituation aufgehoben wurde und
- 2.der Familienangehörige aus einem anderen Mitgliedstaat der Europäischen Union übernommen wird oder sich außerhalb der Europäischen Union befindet und schutzbedürftig ist. Die Erteilung einer Aufenthaltserlaubnis an sonstige Familienangehörige eines Ausländers, dem vorübergehender Schutz nach § 24 Abs. 1 gewährt wurde, richtet sich nach § 36. Auf die nach diesem Absatz aufgenommenen Familienangehörigen findet § 24 Anwendung.
(5) Bei dem Ehegatten oder minderjährigen ledigen Kind eines Ausländers, der im Besitz einer Blauen Karte EU, einer ICT-Karte oder einer Mobiler-ICT-Karte oder eines Aufenthaltstitels nach den §§ 18a, 18b, 18c Absatz 3, den §§ 18d, 18f, 19c Absatz 1 für eine Beschäftigung als leitender Angestellter, als Führungskraft, als Unternehmensspezialist, als Wissenschaftler, als Gastwissenschaftler, als Ingenieur oder Techniker im Forschungsteam eines Gastwissenschaftlers oder als Lehrkraft, nach § 19c Absatz 2 oder 4 Satz 1 oder § 21 ist, wird von der Voraussetzung des Absatzes 1 Nummer 2 abgesehen.
