§ 105a Provisions on Administrative Procedure

Administrative Procedures
State law must not deviate from the provisions on administrative procedures in this Act. This concerns numerous provisions, including on:
- Residence permits and their ancillary conditions
- Integration courses and job-related language courses
- Participation requirements
- Data collection and data transmission
- Authorization to issue regulations
Von den in § 4 Absatz 2 Satz 2, § 15a Abs. 4 Satz 2 und 3, § 23 Abs. 1 Satz 3, § 23a Abs. 1 Satz 1, Abs. 2 Satz 2, § 43 Abs. 4, § 44a Abs. 1 Satz 2, Abs. 3 Satz 1, § 61 Absatz 1d, § 72 Absatz 2, § 73 Abs. 2, Abs. 3 Satz 1 und 2, § 78, mit Ausnahme des Absatzes 1 Satz 8, den §§ 78a, 79 Abs. 2, § 81 Abs. 5, § 82 Abs. 1 Satz 3, Abs. 3, § 87 Absatz 1, 2 Satz 1 und 2, Absatz 4 Satz 1, 3 und 5 und Absatz 5, § 89 Abs. 1 Satz 2 und 3, Abs. 3 und 4, den §§ 90, 90a, 90b, 91 Abs. 1 und 2, § 91a Abs. 3, 4 und 7, § 91c Abs. 1 Satz 2, Abs. 2 Satz 2, Abs. 3 Satz 4 und Abs. 4 Satz 2, § 99 Absatz 1 bis 4, mit Ausnahme von § 99 Absatz 1 Nummer 3a, und § 104a Abs. 7 Satz 2 getroffenen Regelungen und von den auf Grund von § 43 Abs. 4 und § 99 Absatz 1 bis 4, mit Ausnahme von § 99 Absatz 1 Nummer 3a, getroffenen Regelungen des Verwaltungsverfahrens kann durch Landesrecht nicht abgewichen werden.
