§ 98 AufenthG: Administrative Offence Provisions
This text was rewritten into plain language (B1 level) automatically and may contain errors. Only the official German statute is authoritative — when in doubt, read the original text below or consult a lawyer.
This section lists regulatory offences. A regulatory offence is not a crime. But it costs a fine — that is a monetary penalty.
Negligent conduct (paragraph 1) If you negligently commit an act under Section 95 paragraph 1 number 1 or 2, or paragraph 2 number 1 letter b, this is a regulatory offence. Negligent means: you were not careful, but you did not do it intentionally.
These acts are a regulatory offence (paragraph 2) A person commits a regulatory offence if they: Contrary to Section 4 paragraph 2 sentence 1, do not provide proof. Contrary to Section 13 paragraph 1 sentence 2, do not submit to the police check when crossing the border. Contrary to Section 47a sentence 1 or 3, do not present a document named there, or do not present it in time, or do not allow a comparison with the photograph, or do not allow it in time. Contrary to Section 47b, do not make a report. Contrary to Section 48 paragraph 1 or paragraph 3 sentence 1, do not present, hand over, or provide a document, record, or data carrier named there, or do not do so in time. Act against an enforceable order under Section 44a paragraph 1 sentence 1 number 3, sentence 2, or sentence 3. Contrary to Section 82 paragraph 6 sentence 1, also in conjunction with Section 60d paragraph 3 sentence 4, do not make a notification, or do not make it in time.
These acts are a regulatory offence if you do them intentionally or recklessly (paragraph 2a) Reckless is a particularly serious form of negligent. A person commits a regulatory offence if they, intentionally or recklessly: Contrary to Section 4a paragraph 5 sentence 1, engage a foreign national for an ongoing paid service or work that the foreign national performs in order to make a profit. Contrary to Section 4a paragraph 5 sentence 3 number 3 or Section 19a paragraph 1 sentence 2 or 3, do not make a notification, or do not make it correctly, or do not make it in time. Contrary to Section 19b paragraph 7, do not file a report, or do not file it correctly, completely, or in time. Contrary to Section 16g paragraph 4 sentence 1, Section 60c paragraph 5 sentence 1, or Section 60d paragraph 3 sentence 3, do not make a notification, or do not make it correctly, completely, in the prescribed manner, or in time.
Paragraph 2b has been deleted. This means: this rule no longer exists.
These acts are a regulatory offence if you do them intentionally or negligently (paragraph 3) A person commits a regulatory offence if they, intentionally or negligently: Carry out a self-employed activity even though certain rules in this Act do not permit it. These rules are in Section 4a, Section 6, Section 7, Section 16a, Section 16b, Section 16c, Section 16d, Section 16f, Section 17, Section 20, Section 23, and Section 25. Act against an enforceable condition under Section 12 paragraph 2 sentence 2 or paragraph 4. Contrary to Section 12a paragraph 1 sentence 1, do not take up residence, or do not do so for the prescribed period, in the Land where they must live. Act against an enforceable order under Section 12a paragraph 2, 3, or 4 sentence 1, Section 15b paragraph 4 sentence 2, or Section 61 paragraph 1c. Contrary to Section 13 paragraph 1, enter or leave the country outside an approved border crossing point or outside the fixed times, or do not carry a passport or passport substitute. Act against an enforceable order under Section 46 paragraph 1 or Section 61 paragraph 1e. Contrary to Section 60b paragraph 2 sentence 1, do not take all reasonable actions to obtain a recognised and valid passport or passport substitute. Act against a geographic restriction under Section 61 paragraph 1 sentence 1. Contrary to Section 80 paragraph 4, do not submit one of the applications named there. Act against a statutory ordinance under Section 99 paragraph 1 number 3a letter d, number 7, 10, or 13a sentence 1 letter j, if that statutory ordinance refers to this fine provision for a particular case.
An attempt can be punished (paragraph 4) In the cases under paragraph 2 number 2 and paragraph 3 number 3, even the attempt to commit the regulatory offence can be punished. This is a discretionary rule (a "can" rule): the authority decides case by case whether it punishes the attempt.
Amount of the fine (paragraph 5) How high the fine can be depends on which act you committed. This is also a discretionary rule (a "can" rule): the authority sets the exact amount case by case, up to these maximum limits. For the cases under paragraph 2a number 1: up to 500,000 euros. For the cases under paragraph 2a number 2, 3, and 4: up to 30,000 euros. For the cases under paragraph 2 number 2 and paragraph 3 number 1 and number 5b: up to 5,000 euros. For the cases under paragraph 1, paragraph 2 number 1, 2a, and 3, and paragraph 3 number 3: up to 3,000 euros. In all other cases: up to 1,000 euros.
The Geneva Refugee Convention remains valid (paragraph 6) Article 31 paragraph 1 of the Convention Relating to the Status of Refugees (Geneva Refugee Convention) still applies regardless. This section changes nothing about that.
Maximum limit for a criminal offence under Section 95a (paragraph 7) By way of exception to Section 30 paragraph 2 sentence 1 number 1 of the Act on Regulatory Offences, the maximum amount of the fine for a criminal offence under Section 95a paragraph 1 of this Act is 40,000,000 euros.
Maximum limit for a regulatory offence under Section 130 in conjunction with Section 95a (paragraph 8) By way of exception to Section 30 paragraph 2 sentence 2 of the Act on Regulatory Offences, the maximum amount of the fine for a regulatory offence under Section 130 paragraph 1 of the Act on Regulatory Offences in conjunction with Section 95a paragraph 1 of this Act is likewise 40,000,000 euros.
